Independent contractors offer an employer flexibility to meet staffing demands and expertise in areas outside of the employer's business. Like the employers that hire them, independent contractors run their own businesses, set their own schedules, balance conflicting demands and generally work in their own offices without direct supervision. Independent contractors are their own bosses; they are not employees. If an employer manages an independent contractor like an employee, they run the risk that a governmental agency or a court could reclassify the independent contractors as an employee, resulting in significant financial liabilities. Companies are scrambling to establish work from home telecommuting policies in response to the COVID-19 coronavirus. The immediate priorities are the technical prerequisites necessary to get workers connected remotely. The larger challenge is harder to quantify: how to develop and maintain productivity in a virtual work space. Establishing an effective work environment is critical when working from home. This applies to the physical space, technology, and work habits. The key to a productive home office that balances work & family life is the development of an isolation strategy. An increasing number of employers are allowing their employees to use their own personal mobile devices for work purposes, a trend known as BYOD. In fact, as many as 80 percent of smartphones used for work are reportedly employee-owned. But this increased usage of personal devices also brings with it some potential pitfalls for employers. One topic that can generate ongoing confusion for business owners is the classification of an employee as exempt or non-exempt. This can be compounded by the fact that failure to comply with the Fair Labor Standards Act and applicable state and local laws and regulations by misclassifying an employee may result in costly penalties. As the coronavirus (COVID-19) outbreak becomes more acute, employers must consider remote working options and implement emergency communications plans. While an organization already may have been offering flexible work options to certain teams or job classifications, a public health crisis may propel an employer to scale those options to most, if not all, of its workforce. The Equal Employment Opportunity Commission (EEOC) has stated that remote work is one strategy to control transmission of the coronavirus. Federal, state and local labor agencies are following Centers for Disease Control (CDC) recommendations for social distancing and limiting face-to-face contact. The Occupational Safety and Health Administration (OSHA) enforces an employer's legal requirement to provide a workplace free from recognized hazards. Based on these recommendations and compliance requirements, an employer should strongly consider making remote working options available to as many workers as possible. Even if an employee is not generally allowed to work remotely due to particular job duties or the employer's industry (e.g., healthcare), employees with disabilities that put them at high risk for complications associated with COVID-19, or employees who may be pregnant, may request to work remotely as a reasonable accommodation to reduce chances of infection. When it comes to hiring employees, cultural fit has risen in importance, ranking among the top factors for whether to hire a job candidate. The Centers for Disease Control and Prevention (CDC) recently updated its guidance for when it is safe for workers diagnosed with COVID-19 to return to work. Now that the number of confirmed cases of the coronavirus, otherwise known as COViD-19, in the United States are rising, employers should look for ways to protect their employees and workplace. A Jobvite’s recruiting survey found that 83% of respondents used or planned to use social networking this year as a recruitment tool. Over 600 human resources professionals completed Jobvite’s online survey, and not too much surprise, the big sites referenced were LinkedIn, Facebook, and Twitter. Poor records management can cost an organization in two primary ways.  Failure to keep required records can result in fines or other punishments from the government; and failure to retain records of an investigation, claim or complaint can doom a case.  Accordingly, most companies have detailed document retention policies and schedules that should be followed carefully. Whenever in question, the best practice is to ask counsel before destroying any document, especially if it is regarding a contentious employment decision that may lead to litigation. As a small business unemployment tax rate largely depends on the number of past unemployment claims against your business.  May business owners aren't sure how to manage this cost.  While you can't control whether an employee decides to file a claim, you can take steps to reduce the risk of unqualified claims being levied against your organization. Our HR expert Jenni Stone provides some way to proactively protect your unemployment insurance rate. 
According to the EEOC, it is unclear whether COVID-19 is or could be a disability under the ADA. The CDC has identified a number of medical conditions that may put an individual at a higher risk of a serious illness if they contract COVID-19, (e.g., chronic lung disease, serious heart conditions, diabetes, liver disease). Additionally, the EEOC advises that employees with certain preexisting mental health conditions (i.e., anxiety disorder) may have more difficulty handling the disruption to daily life created by the COVID-19 pandemic. The US Citizenship and Immigration Services (USCIS) released a new Form I-9 for employers to sue starting January 31, 2020. Employers may begin using the new form with  revision date of 10/21/2019 now or continue to use the prior version of the Form I-9 (revision date 07/17/2017) until April 30, 2020.  However, beginning May 1, 2020 employers must use the new form and all previous versions of Form I-9 will be invalid.
