We continue our discussion of what happens if a person is investigated for and charged with a white collar crime. In this episode, we discuss what occurs when the defendant wishes to make a plea deal with the government.
Stage magicians have been around since at least the time of the ancient Egyptians. We are amazed at how someone can appear to levitate on stage or how someone can be sawed in half. It should come as no surprise, then that the art of misdirection, so critical to the work of stage magicians, is also in the arsenal of fraudsters and white collar criminals.
This is the second part of a two-part episode. In this episode, I continue my discussions with film critic Alan Cerny regarding movies that have a fraud and/or white collar theme.

There is nothing new under the sun and this includes fraud. Fraud was an issue in the Roman world just as it is an issue for us. Debasement of the currency and the fraudulent use of weights and measures were serious issues in the Roman world..............as well as the machinations of the man thought to be the richest Roman who ever lived.
Dr. Carl Sagan, among his other publications, discussed a "Baloney Detection Kit." This "kit" and the principles within were used by Dr. Sagan to combat pseudoscience and sloppy thinking. However, the nine tools in this Baloney Detection Kit are also an excellent way to combat fraud and white collar crime. I can't promise that by following all 9 rules of the Baloney Detection Kit you will never be a victim of fraud. I can promise, however, that your chances are greatly reduced.

Founded in about 1850, Lehman Brothers became one of the largest investment firms and wealth management organizations in the United States. At one point, it employed 14,000 people and occupied the entire 34 stories of 250 Vesey Street in Manhattan. Then, in September 2008, it all came crashing down. What happened? Was this fraud or incompetence or a bit of both? Let's talk about the fall of Lehman Brothers - one of the largest bankruptcies in the history of the United States.
I apologize to my listeners for the delay in getting this podcast published. Like any other endeavor, martial arts can be the subject of fraud. If a person spends money and invests his time to learn a skill advertised as a "skill that can save a life" but ends up being taught by a charlatan who has no knowledge of the subject, not only is the person's time and money wasted, but a false sense of security is given. This is the literal definition of fraud. In this episode, and the next one, we discuss fraud in the martial arts.

Soon after the Russian invasion of the Ukraine, I discussed how corruption in the Russian Armed Forces was a serious threat to the invasion and Russian society in general. Now, 18 months into the war, Russian corruption has reached the point where the Ukrainians joke that their military consists of four branches: the army, navy, air force and Russian corruption. Let's take another look at how corruption in Russia is destroying the country.

This is a two part episode. We will examine two countries. In this episode, we will look at Iceland - a country which is held up as the "gold standard." Iceland has a very high standard of living, very low corruption index, one of the most crime-free countries in the world and one of the safest place in which to invest money. Yet even in this "Shangri-La," a fraud and financial scandal in 2008 brought the country to economic collapse and destroyed banks that were long thought to be the safest in the world. Even in countries that have very transparent legal and political systems, human nature will always play out, including greed.

If you drive from Houston to Dallas or vice-versa, you will most likely be travelling on IH 45, a major highway in America that runs north to south. Somewhere about 1 hour south of Dallas is the small town of Corsicana - a picturesque town in the heart of Texas with a very famous local business - the Collin Street Bakery. The Collin Street Bakery has been around since 1896 and has the distinction of being the largest, or at least one of the largest, bakers of fruitcakes in the United States. The Collin Street Bakery is one of the landmarks of Texas and certainly the landmark in Corsicana. Love 'em or hate 'em, fruitcakes are a staple of the American Christmas and New Year's scene.
But from 2004 until 2013, the Collin Street Bakery was also the victim of a multi million dollar embezzlement scheme from an unlikely source. We explore the world of fruitcakes and the all-too real world of embezzlement in this episode.

In January 2020, like most people, I was planning my year. I had a vacation planned with my family, my trial schedule set (more or less) and an idea of achieving some goals I had set out for myself. Also in January, I began hearing of a strange virus that originated in Wuhan, China. Once again, like most people, I ignored it as I thought it would not affect my life.
I was, of course, incorrect. The COVID 19 virus has ravaged our world in a manner not seen since the Influenza epidemic of 1918. The full effects of COVID are still not known.
One effect, however, was all-too predictable. Fraudsters and white-collar criminals took advantage of relief programs authorized by the Federal government and billions of dollars have gone to waste. We explore some of the crimes that have occurred with COVID fraud.

Our friend Michael Avenatti is in the news again and as such makes a second appearance on this podcast. On February 4, 2022, Avenatti was convicted of wire fraud and aggravated identity theft in relation to his representation of his former client, Stormy Daniels. We discuss the crimes for which Avenatti was found guilty. We further discuss how Avenatti violated one of the codes of professional responsibility for an attorney - the requirement to keep a client's funds and an attorney's funds separate. The State Bar of Texas requires the separation of client and attorney funds as do most (if not all) State Bars. By violating this principle, Avenatti committed professional misconduct.

Season 2. Episode 1. Notario Publico, Notary Public? What's the difference?
Welcome to 2022. In this first episode of the new year, I discuss the difference between a Notario Publico and a Notary Public. It is a very important distinction because there exist cases of Notary Publics preying on the confusion and linguistic muddy translation between Notario Publico - a very respected and high-level position in Mexico and other Central American countries - and a Notary Public, a person who performs a vastly different role in the American legal system. Some unscrupulous Notary Publics hold themselves out as "Immigration Advisors" and are practicing law without a license. These "advisors" do a great deal of harm to an unsuspecting public. I end the episode by offering some advice to Notary Publics on how to avoid issues with their licenses.
