Who would have thought Senator Lindsey Graham could ever be a point of light amidst the Trump-induced darkness. But after Donald Trump said that Liz Cheney and the members of the January 6th House Select Committee who investigated Trump's January 6th-related crimes should be imprisoned, Senator Lindsey Graham directly contradicted Trump, saying those who investigated January 6th should NOT be imprisoned. If you're interested in supporting our all-volunteer efforts, you can become a Team Justice patron at: / glennkirschner  If you'd like to support us and buy Team Justice and Justice Matters merchandise visit:https://shop.spreadshirt.com/glennkir...Check out Glenn's website at https://glennkirschner.com/Follow Glenn on:Threads: https://www.threads.net/glennkirschner2Twitter: https://www.twitter.com/glennkirschner2Facebook: https://www.facebook.com/glennkirschner2Instagram: https://www.instagram.com/glennkirsch...See Privacy Policy at https://art19.com/privacy and California Privacy Notice at https://art19.com/privacy#do-not-sell-my-info.
Judge Juan Merchan has denied Donald Trump's motion to throw out his 34 felony guilty verdicts based on the Supreme Court's presidential immunity ruling. This ruling moves the case closer to sentencing. The Hill has reported on the legal and criminal problems associated with several of Donald Trump's administration picks, under the headline, "These are the Trump appointees who have faced legal troubles". Given Trump's own guilty verdicts on 34 felony counts, together with the legal troubles of nominees like Charles Kushner, Peter Navarro, and others, the slogan "make America great again" seems less accurate than the slogan "make America felonious again".If you're interested in supporting our all-volunteer efforts, you can become a Team Justice patron at: / glennkirschner  If you'd like to support us and buy Team Justice and Justice Matters merchandise visit:https://shop.spreadshirt.com/glennkir...Check out Glenn's website at https://glennkirschner.com/Follow Glenn on:Threads: https://www.threads.net/glennkirschner2Twitter: https://www.twitter.com/glennkirschner2Facebook: https://www.facebook.com/glennkirschner2Instagram: https://www.instagram.com/glennkirsch...See Privacy Policy at https://art19.com/privacy and California Privacy Notice at https://art19.com/privacy#do-not-sell-my-info.
Once Donald Trump announced that he intended to nominate Kash Patel as the Director of the FBI, the writing was on the wall for the current FBI head Chris Wray. The problem is, FIB Directors are appointed for 10-year terms to help provide some independence and separation between the FBI and the president and his administration. A president can only fire the head of the FBI for good cause. But rather than force Trump's hand into what would be a wrongful firing, Wray "obeyed in advance" and resigned. Wray said he was resigning because, in his opinion, it was best for the FBI. But is it best for the American people? Or for American democracy?
As we continue to look for points of light amidst the Trump-induced darkness, new reporting shows that Trump's demands that his New York civil fraud case and his NY guilty verdicts in his criminal case have been rejected by AG James and DA Bragg, respectively. Manhattan District Attorney Alvin Bragg refused Trump's lawyers' demands to dismiss his criminal guilty verdicts. Per USA Today: "'President-elect immunity does not exist.' New York prosecutors defend Trump conviction". NY Attorney General Leticia James refused Trump's lawyer's demands to dismiss his civil fraud case. It's being reported that President Joe Biden is considering issuing pardons to people who committed no crimes, but who are in Donald Trump crosshairs to be vindictively prosecuted. There are strong arguments on either side of this volatile issue: whether the people who investigated, exposed and attempted to prosecute Trump for his crimes should be given pardons - even though they, themselves have committed no crimes - to prevent Trump's weaponized Justice Department from wrongfully prosecuting those people. Glenn lays out the arguments on both sides of the issue.
Part 1 of a 2 part podcast. Donald Trump is doubling-down on his plan to prosecute the innocent - the members of the January 6th House Select Committee who investigated and exposed Trump's democracy-busting January 6th crimes.Trump defiantly announced that he wants Cheney and the others in prison for investigating him. Trump's promise to vindictively pursue Cheney, Representative Bennie Thompson, and the other members of the committee, is an obvious and extreme abuse of governmental power.

Even as Donald Trump pledges love and pardons for the January 6th defendants - people he told to march on the Capitol and stop the certification of Joe Biden's election win - federal judges are sentencing defendant after defendant for participating in the very attack Trump directed. During four J6 sentencing hearings on Dec. 6th, several federal judges sounded the alarm, highlighting the ongoing danger to American democracy by those who would downplay or misrepresent the nature of the January 6th attack on the Capitol.
Donald Trump hasn't even been sworn in yet, and it seems his influence is waning. Senate Republicans rejected Rick Scott for Senate Majority Leader. Trump's pick for Attorney General, Matt Gaetz, had to withdraw after it became clear that many Senate Republicans would not support him. Trump named Chad Chronister as his pick to head up the Drug Enforcement Administration (DEA) but, after some Republican criticism, Chronister withdrew his name (causing Trump to play catch-up, thereafter claiming that HE pulled Chronister's name). And now, it looks like Trump's pick for Secretary of Defense, Pete Hegseth, is on the fast rack to . . . nope. What do these developments tell us about Trump's influence and control over the Republican Party?
The legal news of the day can be challenging, depressing, and even anxiety producing. So Glenn decided to lighten things up a bit and do a recurring segment called "The Lighter Side of Legal."In this new series, he sits down with TV news legal analysts and discusses things like:who inspired them to pursue legal analyst work?what are their most memorable cases when they were practicing law?what are their most memorable green room encounters?what are their favorite movies involving the law?and many other fun topicsFor the first episode - he sat down with fellow MSNBC legal analyst Danny Cevallos. Donald Trump may be intent on trying to destroy American democracy - saying things like he will be a "dictator on day one", vowing to "terminate" the Constitution, and that, if elected, the American people will never have to vote again - but there are points of light amidst the Trump-induced darkness. Special Counsel Jack Smith filed a motion to dismiss "without prejudice" Trump's federal criminal case for trying to steal the 2020 presidential election. Judge Chutkan granted the dismissal without prejudice, meaning the case can potentially be prosecuted in the future when Trump is no longer president. But how realistic is a future prosecution of Trump for his democracy-busting crimes? And what steps can Trump and his future AG take to try to make any future prosecution impossible? Special Counsel Jack Smith filed motions to dismiss both of Donald Trump's federal criminal cases. The future of Donald Trump's FOUR criminal cases is uncertain. Some may be put on hold and revived after he leaves office, while others may be dismissed before he's sworn in. However, the many civil suits pending against Trump at the moment should continue during his presidency because there have been rulings that he's not immune from many of the cases that individuals have brought against him in his capacity as a private citizen.
Judge Juan Merchan has cancelled Donald Trump's November 26th sentencing date, indefinitely postponing sentencing on his 34 felony guilty verdicts in his New York hush money/falsifying business records/election interference case. I understand your argument about Fed court judges... but...are we actually willing to take a chance that these innocent ppl won't--somehow-- be proven guilty for something that they didn't do? (ie:maybe fake evidence gets planted--don't wanna wade too far into the "future hypothetical weeds"). Look, I realize that Presidential pardons should be treated like a "break glass for emergencies" kind of situations. But also-- this Not Normal time that we find ourselves in... does seems like a "break glass" kind of time (ex. of not normal: orange criminal plans on issuing pardons to the J. 6 rioting thugs, who-- w/o a doubt-- caused much physical damage and harm to police (just doing their jobs-- security detail) and property of the halls of Congress. Interesting debate to have, though.

Thank you, Glenn. A very informative episode! My take: I'm now (officially) tired of Dems always "taking the high road" in situations like these. When the orange criminal/ rapist/ racist and serial lie maker left office in 2021 (and yeah-- repeating-- He Lost in 2020-21; there's even a tape of him admitting so), he pardoned an almost historically Massive amount of ppl (and many of them were Guilty of corruption or refusing a court order...Steve Bannon...cough cough). If these Maga nut jobs are going to act outside the law, why should Biden? Make it make sense. 🧐

" ...in numbers too big to rig and too real to steal..." <====that's Glen's statement, uttered several times on the podcast.

Mr, Kirchner, For what it's worth, here's my opinion. SCOTUS will absolutely NOT tell 45 he has total immunity. Right now, Biden is POTUS, and that same immunity would apply to him. Does anyone think the court would do that? Thanks for letting me voice my opinion. Madeline Holland
