In the third episode of the LES Italia YMC (Young Members Group) Podcast, Lawyers Emanuela Bianco, Alice Viviana Niccoli, Federico Pogliani, and special guest Marko Brumnik discuss the case of Syngenta v. Sumi Agro, where the Munich Local Division (LD) of the Unified Patent Court (UPC) ruled that distributing a patent-infringing product outside the UPC Contracting States, while advertising the product under the same name within a UPC Contracting State, creates a risk that patent-infringing products could be manufactured, marketed, and distributed within the UPC Contracting States in the future. With our guests, we will talk about how this decision reflects broader trends in managing IP risks and opportunities - especially in innovation-driven sectors - as well as discussing some issues that will be will be explored at YMC Pan-Conference to be held in Vienna on November 15th . Sumi Agro, in cui la Divisione Locale di Monaco del Tribunale Unificato dei Brevetti (UPC) ha stabilito che la distribuzione di un prodotto che viola un brevetto al di fuori degli Stati contraenti l'UPC, mentre il prodotto viene pubblicizzato con lo stesso nome all'interno di uno Stato contraente dell'UPC, crea comunque il rischio che i prodotti che violano il brevetto possano essere fabbricati, commercializzati e distribuiti all'interno degli Stati contraenti l'UPC in futuro.
