Description

Welcome to Legal Nurse Podcast. I am Pat Iyer MSN RN LNCC. I am so pleased you decided to listen in. Take a journey of motivation, growth and transformation of your legal nurse consulting practice by learning from successful entrepreneurs. Boost your skills by getting valuable tips from experts from within and outside of legal nurse consulting. In this show I provide two types of podcasts. The first is an interview with an expert who reveals key concepts you may apply to your legal nurse consulting practice. The experts answer probing questions to give you practical tips you can immediately apply. In the second type of podcast, I offer my comments, experience, and lessons learned the hard way to expand on what the interview covered. Here’s what you can expect to get from listening to these programs: tips and strategies, encouragement, sound advice, and more. My podcasts cover what I consider to the 5 pillars of legal nurse consulting. • First you need expertise in your medical knowledge so that you can help clients. • Second, you need to have marketing skills and use strategies that will bring you clients. • Third, you need to follow sound financial practices to collect and wisely spend your dollars. • Fourth, you need to know how to work with clients to strengthen relationships. • Lastly, you need to know how to manage a business. I’ll summarize: The 5 pillars are expertise, marketing, finances, clients and business management. You may listen to Legal Nurse Podcasts on my website at legalnursepodcasts.com or on Itunes. I know some people prefer to listen to information and some prefer to read.If you like to read or to be able to refer again what you’ve just heard, you may request the transcripts of the programs. Get the transcripts on legalnursepodcasts.com. Here’s who I am. I started as an LNC in 1987 when I got my first expert witness case. I spent about 20 years as a medical surgical nursing expert witness testifying in nursing malpractice cases. Also, I spent over 25 years summarizing medical records to explain the facts to juries. In 1989 I started an independent legal nurse consultant business and built it up to become a large and successful business. I sold it in 2015. Along the way I committed 5 years of my life to the American Association of Legal Nurse Consultants, including a year as president. Since I sold my business, I have been writing, editing books, presenting webinars and coaching LNCs. My coaching site is LNCAcademy.com. I love to write, as you will discover when you go to legalnursebusiness.com, my website for LNCs. Many LNCs know me as the chief editor of the second edition of the Legal Nurse Consulting Principles and Practices. It is one of my hundreds of publications, including books, chapters, articles, case studies and online courses. I bring all of this expertise to you. I’d love to hear your thoughts about this show. Let me know what YOU are interested in hearing about. Add your comments to the episode show notes on legalnursepodcasts.com. Thank you for joining us.

In January 2025, we are running the best of our podcasts from the previous year. We pick the shows based on which ones had the most downloads. Enjoy this revisit to our best shows of 2024. As an LNC, you will probably work with cases where the credentials and privileging for doctors are in question. To be able to assess this, you need to understand the complex processes involved. Dr. Vipul Kella, an emergency medicine and highly experienced physician in a number of areas, unravels this complicated web. During the late twentieth century, doctors whose reputations were tainted by malpractice suits and other violations could move from state to state and set up practices and get credentialed and receive medical and surgical privileges. Now a National Practitioner Data Bank exists to flag wayward practitioners, making it more difficult for them to elude detection. Like all systems, it has flaws. Because practitioners may be credentialed in multiple facilities, those who give credentials have much more data to handle. The weight of data involved can penalize blameless practitioners in terms of the time involved to receive credentialing and medical and surgical privileges. Privileges are particularly sensitive. It makes a difference what kind of medicine or surgery is being practiced. Privileges are less likely to be granted for new or experimental surgery, for example. On the other hand, a variant of the “old boy” network may activate. Credentialers will face the challenges of being objective when a colleague, a good friend, wants to be re-credentialed and yet has a series of problems or poor outcomes. There may be a lot of pressure on the hospital to keep them on staff. Dr. Kella’s detailed explanation clarifies many of the issues you may need to untangle in a case involving credentials and privileges in both a hospital and an outpatient setting. What You'll Find in Credentialing and Privileging with Dr. Vipul Kella Podcast What is the purpose of credentialing? How can medical practitioners with questionable histories be identified? What’s the difference between credentialing and privileging? What does remediation involve? Do hospitals share liability with independent medical contractors? In January 2025, we are running the best of our podcasts from the previous year. We pick the shows based on which ones had the most downloads. Enjoy this revisit to our best shows of 2024. As a new LNC’s greatest need is to build a client base, and this is a challenge that never goes away. Both behind the scenes, LNCs and expert witnesses don’t know where to begin, and they can feel intimidated by the process of self-promotion. In essence, the challenge is how to say “Hire me; I can help you” without being blatant about it. In this podcast, Pat Iyer shares nine tips for reaching out to potential clients, for experts and non-experts. She has gleaned them from decades of success both as the owner of an LNC business and as a coach to other legal nurse consultants. She explains why it’s crucial to become known, both in the physical and virtual worlds. In terms of your online presence, it isn’t enough to have a website; you need to make it a source of information to which visitors will return for more. Offer your visitors something valuable in exchange for their email addresses. Make sure you deliver excellent work so that you have the confidence to ask for referrals, both from your attorney clients and colleagues. Your self-confidence will improve when you can ask for evaluation of your work and hear criticism without getting defensive. Consider it an opportunity to learn. How to Get More Clients: Step by step, this podcast will guide you to increasing your outreach and your profit line. How can you make yourself better known to the public? Why do you need a website? What methods help you build your attorney email list? Who can you ask for referrals? How can you benefit from criticism? Professionals have been discussing the concept of nurse burnout and how it affects the profession for at least 50 years. Dr. Lorre Laws, whose Ph.D. is in nursing, realized from her own experiences and from interviewing and speaking to other nurses that the issue has been insufficiently addressed. She decided to rectify this. The result was her book, Nursing Our Healers: A Recovery Guide for Nurse Trauma and Burnout. Check out this podcast episode on Healing Nurse Trauma: Burnout, Self-Care, and Systemic Challenges. Lorre has a deep understanding of the connection between burnout and trauma and believes that, while some sources of burnout are inevitable, many require solving systemic changes. Lack of equipment, for example, forced her to catch a falling patient at the cost of three herniated discs. She also points out that when nurses report abuse by patients, they are often gaslighted, asked how they could have prevented the incident. This literally adds insult to injury. This issue is relevant to LNCs for a number of reasons. Career transition can also be traumatic. The LNC may be somewhat removed from the immediacy of a plaintiff’s traumas, but they must address them, often in a pain and suffering report. They may be subject to the frustrations of an attorney having problems. In addition, they may be exposed to a burned-out, traumatized nurse who made a mistake as a result. In conclusion, Lorre offers two 30-second practices that she recommends doing whenever possible to reduce stress and burnout levels. You can do them anywhere, and she hopes you will. Here's What to Expect from the Podcast: Healing Nurse Trauma: Burnout, Self-Care, and Systemic Challenges What is burnout? What is nurse-specific traumatization? How does this occur? What is second victim trauma? Why do LNCs need to understand the connection between burnout and trauma for nurses? In today’s podcast, The Vital Role of LNCs In Personal Injury cases, I interview a highly successful plaintiff’s personal injury attorney. John Mennie has been practicing law for 38 years and has won more than $150 million in awards. He works extensively with legal nurse consultants, and he has a lot of information to share with you. Issues with insurance, for example, can be complex. Many people are underinsured, which leads to complex issues. In addition, hospital billing offices make mistakes. An LNC can be invaluable in He says one of the most valuable roles an LNC can serve is to explain the issues in a way that simplifies them. Attorneys in his field have some understanding of medical terms, procedures, and practices, but an LNC’s hands-on day-to-day experience brings much more direct understanding of issues. In terms of medical reports, John emphasizes that illustrations can convey the pain and suffering a plaintiff has experienced much more strongly than words. An image of a procedure has a visceral impact that a juror will not soon forget. Whether you listen to, view it on YouTube @legalnursebusiness.com, or read this podcast, you’ll find its information invaluable. When you think about falls, your first thought may be of nursing home or hospital falls. However, a large percentage of falls and other injuries occur on the job. Learn more in this podcast episode: Falls at Work: Legal Insights and Challenges. Laura Chung, an LNC based in California, shares with us the complexities of fall cases. Slippery or buckled floors, wet spots, hidden holes, and other structural issues can cause serious injuries. These injuries are complicated further by supervisors who may shuffle the injured worker to a clinic rather than to needed care in an emergency department of a hospital. The company that insures the business that employs the worker may deny needed care. A supervisor may want to avoid the usual method of reporting an injury because he wants a clean safety record. A reportable incident usually goes to OSHA (Occupational Safety Health Administration), which has the option to investigate the company and possibly fine them for violations. These fines can be for major amounts of money. Sometimes the workers, due to substance abuse, may be investigated. Some may be undocumented workers. Still others fail to show up for physical therapy or other medical appointments. Add to this the unusual number of documentation that this kind of investigation seems to spawn, and you can end up with a data nightmare. Laura’s thoughtful explanation of the various issues involved will prove invaluable to you if you end up with a workplace fall case. Here's What to Expect from the Podcast: Falls at Work: Legal Insights and Challenges What locations have the most falls? How does the U.S.’s worker compensation system complicate both treatment and payment? Why can it be difficult for workers to get the emergency care they need? This podcast,Transitioning from Clinician to Legal Consultant, provides a more uncommon perspective on the world of medical malpractice. Jeff Willis, MD, served as a board-certified emergency department practitioner. In time, he shifted his professional focus to working with attorneys. In his new career, he has seen the best and worst of medical care. This career has grown rapidly. He works as a consulting physician, and he has gotten most of his clientele by writing about medical cases on LinkedIn. He doesn’t actively seek contacts, although when he concludes a successful case, he will ask the attorney for referrals—and he gets them. He’s acquired a lot of experience in a brief time, and from his altered perspective, he’s observed that most medical malpractice suits stem from systemic errors. For example, there will be insufficient safeguards to prevent someone getting the wrong medication or blood. Due to the lack of communication in hospitals, even those part of the same system, Hospital B, which is in the same system as Hospital A, will make the same error. Lawsuits also occur when the hospital doesn’t proactively explain to the affected parties why the error occurred. Most plaintiffs want to make sure that the tragedy that impacted their lives doesn’t reoccur. Sometimes it takes the Center for Medicare and Medicaid Service to initiate effective change. You’ll find this physician’s perspective on medical malpractice fascinating, and you’ll learn a lot from this podcast. Here's What to Expect from the Podcast: Transitioning from Clinician to Legal Consultant: What do malpractice clients want to accomplish? What difference does it make when the hospital is proactive in explaining what went wrong? Why has it gotten more difficult to find suitable expert witnesses? Why is LinkedIn a good way to build your practice? What is the greatest cause of medical errors? In this podcast, Enhancing Surgical Outcomes: The Vital Work of RNFAs, we investigate an area of nursing that you may not know about: the registered nurse first assistant, or RNFA. You will find this practitioner in the operating room assisting the surgeon. Anna Gray, who serves in this role, is here to explain what it involves. This is a position that requires years of training and passing a difficult examination. It’s an expanded set of nursing skills that involves both knowledge of the dynamics of an OR and a deep understanding of surgical processes. And that’s not all. Communication skills assume paramount importance in this position. The RNFA must coordinate the flow of work and appropriately delegate tasks so that surgeons have everything they need to successfully perform the operation. It might be considered a high-level version of directing traffic in order to keep traffic flowing smoothly. Having RNFAs working in an OR is frankly more cost-effective than having another surgeon as first assist, and both surgeons and hospitals have embraced having these highly-qualified nurses in the OR. For LNCs, though, the RNFA’s role is problematic, since it’s not required to be documented. This will prove frustrating to LNCs, as they often need to figure out, when an operation goes wrong, why it happened. OR notes may not even record that the RNFA was present. Anna says she relies on the operating room nurse to record her presence, but LNCs may also want to dig down to discover if an RFNA was working in the OR. Here's What to Expect from the Podcast: Enhancing Surgical Outcomes: The Vital Work of RNFAs What is an RNFA? What education and training does it require? How has having an RNFA available in a hospital become a selling point? What questions should an LNC ask about how the RNFA functioned in an operating room scenario? How can an LNC deal with lack of requirements for an RNFA to keep records of what goes on in an OR? Cheri Martin, known as the social visionary, is a renowned LinkedIn expert. In the How LNCs Can Connect with Attorneys Using LinkedIn session from the LNC Success Conference, she provides detailed information about how to get the most out of LinkedIn at no cost. In her experience with clients, this platform yields the most consistent and powerful results by following simple principles of engagement. First, understand that LinkedIn isn’t for sales. Its purpose is to help you make connections. Connect intentionally. Know who you want to reach. Communicate with purpose. Create relevant content. These are the fundamental guidelines. Don’t try to connect with the maximum number of attorneys. If you have effective relationships with ten, you can focus on nurturing those. The more you build the know, like, trust factor, the more likely you are to organically attract other connections. Send them birthday greetings; congratulate them on a promotion. Send them links to articles you think will have meaning for them. These practices keep you top of mind. When they need someone who can provide your kinds of services, they will reach out. In addition, Cheri describes some of LinkedIn’s newer services, which can expand your outreach. LinkedIn, Cheri says, takes the “cold” out of cold calling. We all want that, and studying this podcast will help you achieve that goal. Here's What to Expect from the Podcast: How LNCs Can Connect with Attorneys Using LinkedIn What are the three initial steps to take on Linked In? In this transcript, you’ll have the opportunity to learn from an expert about the 5 Proven Steps to Boost LNC Referral Success. Asking for referrals is for many one of the most challenging aspects of building a business. It’s also one of the most essential elements. That’s why learning and practicing Tiffanie Kellog’s five-step program can make this process so much easier. She begins with the foundation: Who do you want to reach? Who is your ideal client? She leans into being specific. You can even mentally construct an image of this client. Next, look at your network. Who can help you? Who are your referral sources? What do you want them to tell their contacts or associates about you? Here is where you again have to go beyond self-consciousness and be clear on what you have to offer. Keep in mind that you may be able to reciprocate by offering referrals to your referral source. You want to both educate and motivate your potential referral source. In this process, don’t overload them with information. Only provide that which is relevant. Step by step, Tiffanie will guide you through a specific and workable program for building your business through referrals. As you practice it, your networking skills will grow, and your business will reflect your efforts. Here's What to Expect from the Podcast: 5 Proven Steps to Boost LNC Referral Success Who is your ideal client? How can you activate your referral sources? What message do we want our referral sources to share? Why are motivation and education both necessary to get referrals? Why is it important to make your request specific? The phone rings, and a potential client is calling. Are you prepared, ready to put your best foot forward? Do you have an intake form ready? Are you able to answer questions he or she might ask? Or do you feel nervous and shaky and sure that you’re going to blow it? Listen to this week's episode titled Confidently Handle Attorney Inquiries. Pat Iyer and Barbara Levin, highly experienced LNCs will, in this podcast, help you feel confident and ready to handle attorney inquiries. Start off by shifting the focus from yourself. Draw on your clinical experience, thinking of the first time you meet a patient. You know that person is in pain and frightened. Your job as a nurse is to help them. You may not think of an attorney as someone in pain and frightened. Think again. The welfare of their clients is their responsibility, their legal obligation. They are hoping that you can help them. Your primary responsibility is to demonstrate that you are that person. Equip yourself with tools to reinforce that impression. You have an intake form; you know the questions to ask. You state your fees without apology and  ask for a retainer. Ask informed questions, and  don’t make promises you can’t keep. You’ll learn how to do all this and much more in this information-packed podcast. Here's What to Expect from the Podcast: Confidently Handle Attorney Inquiries Do you use an intake form when a new client calls? Do you follow up with some form of thanks to whomever referred you? How do you check for a possible conflict of interest? How do you handle retainer fees? Under what circumstances might you reduce your rates? This is my second solo podcast on the topic of difficult clients. In this podcast, Client Disputes and Departures – LNC Nightmares, I describe some of the diverse issues associated with fee collection. As always, I share some of the mistakes I’ve made—so that you won’t make them. The first issue for you to consider if clients aren’t paying is the quality of your work product. Attorneys require well-written, accurate, and error-free reports. The best ones will tell you when your report doesn’t meet their standards. Sometimes attorneys fail to accurately represent what they need in a report. I describe a case where that happened to me. It’s of primary importance for you to spell out every detail of the contract you have the attorney sign. That includes payment schedules, the disallowance of contingency payments, the point at which you will involve a collection agency, and other issues. You also need to decide when you will grant clients some slack. This should always be based on their value to your business. When clients disappear, it’s always a good idea to find out way. Some reasons have nothing to do with the quality of your work, and that’s a good thing to know. It’s equally valuable to know if the client has an issue with your work product. You can always improve. Here's What to Expect from the Podcast: Client Disputes and Departures – LNC Nightmares - Pat Iyer Are low-quality reports preventing you from collecting fees? What do attorneys look for in a report? How can you get clarity on what an attorney wants? How should you handle an attorney’s cash flow problem? Why is it so important to get part of your fee in advance? If you lose a client, how can you find out why? In this session, Handling Tough Clients: Business Insights for LNCs, you’ll discover valuable lessons I've learned from working with attorneys. Listening to or reading this podcast can save you thousands of dollars and untold misery. I take up three major difficult client situations. The first is the importance of boundaries. You need to make it clear when you are and are not available to clients. Set those boundaries and safeguard them. You will prevent a lot of stress in your life. Money issues can be huge for legal nurse consultants. As a novice LNC, I didn’t increase my rates as regularly as I should have. I’ve learned to see this in the context of cost-of-living increases. Like everyone, I have increased expenses. If I want to stay in business, I need to pass them on to the client. Rest assured that they are doing the same and learn to state your increases in a matter-of-fact way. I give some specific suggestions. It took me a while to catch on to the idea of rush fees. ALWAYS charge rush fees when needed. If you are dealing with a new client, ask for a retainer upfront. The third important element is client fit. Some clients are very difficult to work with, and I'll share with you some strategies for managing the client fit problem. Here's What to Expect from the Podcast: Handling Tough Clients: Business Insights for LNCs - Pat Iyer Why is setting boundaries essential to your LNC business? Why is it important to systematically and regularly increase your fees? How can you tell your clients in a friendly and candid way that you need to increase expenses? What is scope creep? Today’s podcast, The Role of Legal Nurses in Placenta Accreta Cases, discusses a serious condition called placenta accreta. When this occurs, the placenta attaches to the uterus, causing major difficulties in the delivery of the infant. Nurse specialist Katie Roberts goes into depth about this medical condition. While the condition is rare, it’s on the rise. Katie explains that cesarian sections and placenta previa are some of the risks for placenta accreta. Another risk factor is a pregnancy in which there have been no ultrasounds and sometimes no medical supervision at all. This prevents the obstetrician from preparing safely for the delivery. A carefully planned delivery, often by cesarian section, involves a complete team of medical practitioners. A primary goal is to prevent excessive blood loss, and when deemed appropriate, to schedule the delivery in advance of the anticipated due date. An LNC experienced in obstetrics can make a major contribution to the evaluation of a case involving placenta accreta. He or she can assess the medical personnel’s consideration of the risk factors and preparedness to prevent crises, as well as determining whether the optimal procedures were used. Katie points out that, due in part to women becoming pregnant at increasingly older ages, the risk of placenta accreta correspondingly increases. That alone makes this a valuable podcast for you. Here's What to Expect from the Podcast: The Role of Legal Nurses in Placenta Accreta Cases - Katie Roberts What are the risk factors for a placenta accreta? Why are cesarean sections currently so common? How and when can a placenta accreta be detected? What medical personnel is needed to handle a placenta accreta? In this podcast episode, we explore Unveiling Child Abuse Signals. We discuss one of the most disturbing and problematic areas of health care and forensic medicine: child abuse, which may be physical, sexual, emotional, or due to neglect. Katie Holmes, a pediatric nurse practitioner with over 17 years of experience, assists attorneys with child abuse and other child-related cases. She’s here to share her wealth of information in this critical area. She emphasizes the importance of teaching children about inappropriate touching and their right to say “no.” This should be part of a child’s early education. Evaluation of physical injuries has to be done carefully, and the kind of injury must be correlated to the age of a child. An eight-month-old baby may roll out of a bed, but it is highly unlikely that a three-week-old baby will. It’s also essential to have a pediatric ophthalmologist examine for retinal damage. The kinds of skull injuries sustained are also significant. While it’s always wise to be alert for abuse, Katie points out that some injuries are caused by genetic conditions. Some children may sustain fractures from a blood pressure test. Others have bruised-looking skin from hereditary conditions. This is a highly sensitive area for all health practitioners, and LNCs share the responsibility to thoroughly investigate. This podcast will give you a great start. Here's What to Expect from the Podcast: Unveiling Child Abuse Signals - Katie Holmes What are the different kinds of child abuse? What’s the profile of a child abuser? How can you warn children about potential sexual abusers in a matter-of-fact way? How does age affect evaluation of injuries? In this podcast episode, we explore Crafting Effective Chronologies for Legal Nurses. Creating chronologies that have multi-purpose functions in a range of cases is one of the services attorneys are most likely to request. Today we have an expert in this area, Mary Beth Kerstein, who will share with you what she’s learned about this important service. Attorneys lack both the time and medical expertise to prepare a chronology, and it’s not a job that can be handed off to a paralegal. This is where LNCs can prove their value. Mary Beth addresses a number of practical issues. Since all records don’t arrive at the same time, you need to find a way to indicate new information for the attorney’s benefit. She details how to do this. The biggest issue is deciding what information is pertinent for a chronology. As this will also determine the length and number of billing hours required, she recommends that you ask the attorney what he or she wants. You can also provide samples of chronologies you’ve done. She emphasizes that the chronology should be opinion-free. Expert witnesses, opposing attorneys, and other parties may see this. If the attorney wants it, you can provide your opinion about the case in a separate email. You can also offer to provide additional services, like a list of providers or a medical glossary. You will find the content of this podcast to be an invaluable resource to help you excel in this highly requested service. Here's What to Expect from the Podcast: Crafting Effective Chronologies for Legal Nurses - Mary Beth Kerstein How does an attorney benefit from having an LNC prepare a chronology? How do you organize a chronology where multiple providers are involved? How do you discern what’s important to put into a chronology? Should chronologies be opinion-free? What are invisible injuries? As a legal nurse consultant, you will be evaluating both the physicians who may be defendants in lawsuits and in the selection of physician expert witnesses. What standards are most effective in making those choices? Discover the answers in our podcast episode: Expert Witness Essentials: Evaluating Physician Credentials. Here to help us in making those decisions is Dr. Kayur Patel, who has spent much of his professional life looking at quality of care issues from various perspectives. He breaks down the stages of the very long path of a would-be doctor’s journey. One issue he demystifies is whether going to a non-U.S. medical school is a handicap in terms of professional reputation. As long as a student passes the USMLE (U.S. Medical Licensing Examination), they are qualified. He also explains about board certification in a specialty. Roughly 60% of doctors are not board-certified. Board certification gives an extra layer of credibility. Dr. Patel says that board-certified doctors are less likely to be involved in malpractice suits. They are seen as having greater credentials than doctors without that extra credential. Given the challenge of selecting expert witnesses, this distinction will help LNCs make the choice that can often influence juries. This podcast will help LNCs and also lawyers to understand the detailed and prolonged training doctors go through.
