SPECIAL EDITION: The Senate races.

On November 5, in addition to presidential, House, state and local elections, voters will be casting ballots in 34 Senate elections in 33 different states. Currently, a coalition of 47 Democrats and four independent senators holds a 51-49 advantage over Republicans in Congress’s upper chamber. This year, Republicans are only defending 11 of the 33 Senate seats up for election and are likely to hold all 11. Two of the 23 Democratic seats up for election — in West Virginia and Montana — are rated solid Republican and lean Republican, respectively, by Cook Political Report.Ad-free podcasts are here! Many listeners have been asking for an ad-free version of this podcast that they could subscribe to — and we finally launched it. FEMA funding and the disaster response.

Last Wednesday, Hurricane Milton made landfall in Florida as a Category 3 storm, knocking out power to 3.2 million people and killing at least eight. Two weeks earlier, Hurricane Helene ravaged the Southeast, killing more than 250 people and resulting in widespread devastation. The Federal Emergency Management Agency (FEMA), which coordinates the federal response to disasters that exceed the capabilities of local and state authorities, has become the target of criticism for its response to these storms — particularly from conservative commentators — pertaining to how it allocates resources, its responsiveness, and its funding. Ad-free podcasts are here! Many listeners have been asking for an ad-free version of this podcast that they could subscribe to — and we finally launched it. The Supreme Court takes up ghost guns.

On Tuesday, the Supreme Court heard oral arguments in Garland v. VanDerStok, a case challenging a 2022 Biden administration rule that regulated unserialized firearms, also known as “ghost guns.” A group of firearms owners, gun rights groups and manufacturers challenged the rule, arguing that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) exceeded its authority in issuing the regulation. During arguments, a majority of justices on the court seemed skeptical of the plaintiffs’ case, indicating that they would uphold the rule when they issue their decision in summer 2025. Ad-free podcasts are here! For the last few years, we've been publishing a daily podcast similar to our newsletter and bonus content exclusively for our podcast channel. Donald Trump and Elon Musk

On Saturday, the tech executive joined former President Donald Trump at a rally in Butler, Pennsylvania, the site of the attempted assassination of Trump in July. Musk, the CEO of Tesla and SpaceX and the owner of X (formerly Twitter), addressed the rally’s attendees and reaffirmed his support for Trump’s candidacy while criticizing Democrats on a range of issues. Broadly, the speech exemplified Musk’s evolution from a political moderate to an outspoken advocate for the former president. Ad-free podcasts are here! For the last few years, we've been publishing a daily podcast similar to our newsletter and bonus content exclusively for our podcast channel. Jack Smith's new filing on Donald Trump.

On Wednesday, U.S. District Judge Tanya Chutkan unsealed special counsel Jack Smith’s latest filing in United States v. Donald Trump, concerning alleged criminal actions committed by the former president following his defeat in the 2020 presidential election. In the filing, Smith argues that Trump "resorted to crimes" to remain in power and was acting outside the scope of his official duties as president when he pressured state officials and then-Vice President Mike Pence to overturn his 2020 election loss.Ad-free podcasts are here! For the last few years, we've been publishing a daily podcast similar to our newsletter and bonus content exclusively for our podcast channel. The dockworkers go on strike.

The dockworkers’ strike. On Tuesday, thousands of longshoremen and port operators along the East Coast and Gulf Coast went on strike after their union, the International Longshoremen’s Association (ILA), failed to reach an agreement with the United States Maritime Alliance (USMX) on a new contract. The ILA, which represents over 45,000 workers, is asking for higher wages for its members and protections against port automation projects. The strike is the first large-scale work stoppage for dockworkers in nearly 50 years and has halted nearly all activity at some of the busiest ports in the United States. Ad-free podcasts are here! For the last few years, we've been publishing a daily podcast similar to our newsletter and bonus content exclusively for our podcast channel. The agreement, announced by Senate Majority Leader Chuck Schumer (D-NY) and House Speaker Mike Johnson (R-LA), will fund federal agencies at their current levels — with a provision for $231 million in additional funding for the U.S. Secret Service — pushing negotiations over the full-year spending bill until after the election. You can read today's podcast here, our “Under the Radar” story here and today’s “Have a nice day” story here. You can watch the replay of our live stream of the Harris Trump debate with commentary from Isaac on our YouTube Channel!Check out Episode 6 of our podcast series, The Undecideds.
