I break down the Kouri Richins infamous “Walk The Dog” letter found in her jail cell. She claims this letter was part of a fictional book she was working on. The prosecution disagreed with that sentiment and requested sanctions be placed on Richins. On Monday, Kouri Richins wrote a statement claiming her eagerness to proceed with the trial and prove her innocence. Eric Richins's estate put out a statement saying that they are confident in the judicial system and there will be enough evidence for a jury to convict her.We still have a long way to go before a trial can be set. First, Kouri needs a new defense attorney, then the preliminary hearing needs to happen. ResourcesYouTube Live Stream: https://youtube.com/live/9vmnAHDbBJ0This podcast uses the following third-party services for analysis: Spotify Ad Analytics - https://www.spotify.com/us/legal/ad-analytics-privacy-policy/Podscribe - https://podscribe.com/privacyChartable - https://chartable.com/privacy

The defense argues that the grand jury indictment should be dismissed due to prosecutorial bad faith and that there were structural errors in the grand jury indictment. The judge asked pointed questions to the prosecution about their conduct. The prosecution had leaked the date of the indictment to the New York Times, cut off witnesses during their testimony, and didn't reach out to other possible witnesses' attorneys to let them know they might be needed for that hearing. The judge stated that they would make a written ruling this week and with the amount of questions the judge had, it is possible that the dismissal could get granted. Kouri Richins’ defense attorneys filed a motion to disqualify the prosecution and to designate the "Walk The Dog" letter as attorney-client privilege. Subsequently, the firm withdrew from her case. This will delay Richins's preliminary hearing that is currently set for June. This podcast uses the following third-party services for analysis: Spotify Ad Analytics - https://www.spotify.com/us/legal/ad-analytics-privacy-policy/Podscribe - https://podscribe.com/privacyChartable - https://chartable.com/privacy

The defense and prosecution agree that the hearing scheduled for May 16th, 2024 should be closed but do not agree that the hearing on May 14th, 2024 should also be closed.Ann Taylor argues the hearing on May 14th should not be closed because it is in the interest of Kohberger's 6th Amendment Right to have a public trial. The prosecution argues that the proceedings before the public trial are not obligated to be in the public and that they need to balance the interests, privacy, and sensitive information as a right to a fair trial.Judge John Judge ultimately sides with the prosecution to have a closed hearing on May 14th, 2024 signing a subpoena for the FBI to produce evidence for cell towers, amongst other things, that should have been provided over 6 months ago.RESOURCESLaw Nerd TV: https://youtu.be/A7Qe944eA3AThis podcast uses the following third-party services for analysis: Spotify Ad Analytics - https://www.spotify.com/us/legal/ad-analytics-privacy-policy/Podscribe - https://podscribe.com/privacyChartable - https://chartable.com/privacy

The prosecution and defense paint different pictures of what happened on the night of his death. The prosecution claims that Karen and John had problems in their relationship and that she ran him over with her car while drunk, before fleeing the crime scene. The defense states that Karen dropped off her boyfriend at a party with his work colleagues and that it is more likely that he was attacked in the home before being left outside in the blizzard to die. Karen also claims she is being set up by the cops as a cover-up for their actions. A Federal investigation is also currently being conducted but has not yet concluded. In contrast to the prosecution's evidence, Federal investigators say that they do not believe John O'Keefe was hit by a car.The jury selection begins Tuesday, April 16th, 2024, and I will be covering it gavel to gavel! This podcast uses the following third-party services for analysis: Spotify Ad Analytics - https://www.spotify.com/us/legal/ad-analytics-privacy-policy/Podscribe - https://podscribe.com/privacyChartable - https://chartable.com/privacy
Hannah Gutierrez's attorney requested the court to do a conditional discharge which places her on probation with certain conditions. Upon the successful completion of that probation, there will be no conviction on her record. The prosecution responded that Hannah is eligible for a conditional discharge, however, it should not be granted because other felonies are pending and cites failure to accept responsibility due to what was said in the recorded jail calls. I'll be live on the Emily D. Baker YouTube channel to cover the sentencing on Monday, April 15th at 11 am CST.The state responded to Alec Baldwin's motion to dismiss the indictment. The state detailed how they followed the rules of the grand jury and why the trial should move forward. They also explained the reason for rescinding the original plea deal. The state says that after they extended the plea deal to Alec Baldwin, they never responded to the email, told a reporter about the nature of the plea deal, commissioned a documentary about the shooting, and pressured witnesses to be interviewed in the documentary. In a new filing, Diddy and his son, Christian "King" Combs, were sued by a crew member and bartender on a yacht. The attorney representing this case is the same attorney representing Lil' Rod. In an unrelated case, the attorney has been referred to the discipline committee for filing cases in federal court to boost media attention.Bryan Kohberger had a fiery hearing. The TikTok Psychic was mentioned by the survey expert, Bryan Edelman, as part of misinformation that is floating around about the case. A video of the prosecutor, Bill, was used as an example of disseminating information.Bill accused Edelman of tainting the jury pool and Edelman said he was so angry it made him cry. The judge didn't make a ruling but did push back the change of venue hearing to June 27th, 2024, and kept the May 14th, 2024 Hearing to go over a motion to compel. This podcast uses the following third-party services for analysis: Spotify Ad Analytics - https://www.spotify.com/us/legal/ad-analytics-privacy-policy/Podscribe - https://podscribe.com/privacyChartable - https://chartable.com/privacy

I absolutely love The Emily Show and follow her on YouTube (Emily D. Baker) as well as on patreon. She is quite literally the only creator I've followed on every platform because her content is THAT good. She's intelligent, hilarious, down to earth and she takes all the legal mumbo jumbo and brings it down to earth in relatable ways. (Don't be shocked with her love of the cursey words and I dare you not to laugh when you figure out what she calls a "motion to preserve evidence" lol. Love The Emily Show! 5/5 stars! Highly educational and entertaining.
