On Thursday July 28, 2016 at apx. 8AM Central, we were forcibly taken out of out home at gunpoint. I've been staring at the sentence structure of the TRANSFER OF RIGHTS IN THE PROPERTY paragraph located just below the definition section of the Fannie/Freddie uniform mortgage instrument. If you really think that this is crazy talk, then my brutally loving English professors are rolling in their graves... i was an ace in writing. Since 1981, I've written, helped write and edited so many contracts and technical articles, i come at this with near expert level review... So, let's slow down and use our 300 level English skills to analyze it based on what is really says versus what we want or anticipate it to mean... and while it may sound like legal heresy; court opinions notwithstanding... Presumptions can be fatal and repeating errors of the past do not render such errors true and correct... (i give you the civil rights movement as a prime example) After all, contract law (as well as legislation) is based on the unambiguous meaning of the written word, and when clear on its face, must be taken (not interpreted) as meaning what was written, and saying only that... Note that this language comes from a document which is purported to be a uniform Fannie/Freddie instrument so; portions may apply to all people: To wit: "For this purpose, Borrower does hereby mortgage, grant and convey to Lender and Lender's successors and assigns, the following described property located in the COUNTY of COOK: SEE LEGAL DESCRIPTION ATTACHED HERETO AND MADE A PART HEREOF." Truly, if the sole intent was to grant a mortgage security lien attaching to the property in the event of default, the sentence might read something like: "...Borrower does hereby grant and convey a/this mortgage to Lender securing the following described property..." THIS IS NOT WHAT IS WRITTEN!

Using his process, he got his home free & clear. He discovered the wool had been pulled over his eyes. He describes the fraud he found in the process and the fact that your house was paid in full immediately after the closing. He tells us how he clawed his way out and how you might, too. The bank does not let you know that a promissory note is actually a "negotiable instrument" under the Uniform Commercial Code, and that it will be deposited to fund your loan. Nor did they tell you that the bank has a liability to you of approximately the amount of the loan. (The bank owes you by their own bookkeeping entries!) The bank does NOT tell you that you actually provided the real cash value for your own loan! Thus, the bank only appears to be lending you anything. "The Federal Reserve Banks create money out of thin air to buy Government bonds... The Federal Reserve Bank is a total money making machine." Representative Wright Patman, former Chairman of the House Banking Committee That's right: banks and lending institutions only appear to lend money. Let's take a quick look at how money is created at the "government" level, and then we'll see how this applies to you and your alleged debt. But is it money? Where did the Federal Reserve get the money to exchange for the government bonds? It made a bookkeeping entry. That's it! Money is created by the banks out of thin air! Our government gave them that power when it created the Federal Reserve System. The Federal Reserve creates money out of nothing; this is usury, the payment of interest on pretended loans; the true cause of the hidden tax called inflation; the way in which the Fed creates boom-bust cycles. This technique was developed by political and monetary wizards to create money out of nothing for the purpose of lending. Ackley. To simply call Randy a just another Florida attorney would be like calling the sun just another star... His knowledge and 29 years of experience has taken him around the world dealing with legal and humanitarian disasters and crisis giving him insights and problem solving skills which are second to none. This evening Randy will be taking us on a trip through the nature and construction of Unconscionable Contracts those David & Goliath types of deals where one side is so large and intimidating; the other side simply must agree or be out in the cold. Almost every deal a consumer is offered today by banks and other large corporations has adhesion clauses - or what you might call take-it-or-leave-it terms. In any other form of business, these terms would be ruled unenforceable in a court of equity and stricken or modified... but when it comes to banks, it seems the courts are reluctant to do anything to allow a remedy... Randy has some ideas you might find useful and thought provoking, and maybe even a solution or two. -You mentioned that most people in America still dont understand that homeowners defending foreclosures are the victims of a syndicated criminal enterprise, right? Well what about homeowners who are still keeping up their payments and not in foreclosure... are they victims too? What is an unconscionable contract, by definition? Can you hit on some of the most common terms of adhesion which bind a party without the ability to negotiate? Do you have any ideas why courts support these terms in a bank contract when they would most likely strike or modify them if it were between you and me? Are there any examples of courts going the other direction and acknowledging the fact that the homeowner was unable to create a fair, negotiated contract? If you find terms, which in any other case are unconscionable, how do you get the judge to sit up and pay attention instead of denying the defense? How hard is it to demonstrate and prove unclean hands on the part of the banking system in a particular case? How does MERS it into the scheme and what consequences has it brought upon the homeowner? What about non-MERS deals, are they similarly affected? Is it possible to get a judge in equity to listen to arguments of law or statute in a foreclosure case? Do you see the concept of trying to get a free house being the act of the homeowner or the bank? If a bank or servicer cant prove they or the originator funded a loan, how can they have standing? Have you looked into the possibility that because of the way things are crafted in the UCC, that a bank loses its ability to enforce the note with its security, after 9 months... and they may be foreclosing on a persons estate instead? If a bank has no money of its own to lend and the franchise rules found in Title 12 forbid it from using depositors money or its credit, where is the money coming from and how can they enforce a contract they never funded? What about the Security First rule (as in California), where if the so-called lender is made whole, even by way of insurance or derivatives, that they lose their claim on the collateral and the house returns to the grantor/homeowner by reversionary right? Have you looked into that? Why do some courts make it difficult for homeowners or their lawyers to get evidence admitted? Can you give some examples of effective pleadings or affirmative defenses/counterclaims? What are some of the hardest bank allegations to overcome? What is your definition of a successful challenge to a foreclosure? Can a homeowner really win against a bank and make them go away? What are some of the most frequent procedural mistakes committed by homeowners? What are some of the more important laws you might cite in a foreclosure defense? Is it possible to get a judge in equity to listen to arguments of law or statute in a foreclosure case? What are some of the most effective strategies in defense of foreclosure? What is your opinion about homeowners using TILA rescission as a way to change the nature of a case from a secured foreclosure to an unsecured debt collection attempt? In general, what things would you recommend for improvement in the area of evidence & procedure to make homeowners' foreclosure defenses more effective? EPISODE34 - BOB HURT -Bust em for wrongs against you & avoid ambush!

A native Texan, Bob Hurt quips according to documented legend, he entered the world on 5/29/1943 at 4 A.M. in Houstons Herman Hospital. After high school he served 9 years in the U.S. Navy; mostly aboard submarines. Following his Navy service, he worked in the computer & electronics industry in one way or another until he retired. His various roles included technician, engineer, programmer, writer, trainer, marketer, salesman, web designer, manufacturer, senior executive, and CEO. Now based in Clearwater, Florida; Bob considers himself a truth-seeker. So in 2006 he decided to start studying law. Since then he has analyzed and written his personal reviews and thoughts on a number of topics and cases, from a legal laymans perspective. A prolific writer, in addition to law; Bob has penned many articles on topics ranging from health and philosophy to politics and the arts... with even a few recipes tossed in there. After the housing bubble crash of 2008, he was disturbed when saw millions of Americans start losing their homes in foreclosure; often from fear and lack of understanding; but also sometimes from bad or inept lawyering. So he adopted the cause of trying to help homeowners by studying to figure out the best ways to save their homes. The outgrowth of this work was the creation of his consumer advocacy website www.MortgageAttack.com, where he posts articles and blogs on the subject of defending against foreclosure by attacking the errors, omissions and plain-old violations of law found in the initial mortgage and servicing contracts.
