RAW COURT AUDIO-Lori Vallow Daybell Ordered to Undergo Competency Evaluations Before Arizona Case Resumes

Lori Vallow Daybell will be subject to additional mental health evaluations before her legal proceedings in Arizona can move forward. Judge Justin Beresky issued the decision during a hearing, keeping a Rule 11 competency evaluation in place despite objections from her defense team.   The evaluations are part of Daybell’s ongoing legal troubles in Arizona, where she faces conspiracy to commit murder charges tied to the deaths of her fourth husband, Charles Vallow, and her former nephew-in-law, Brandon Boudreaux.   Daybell was extradited from Idaho to Arizona a year ago. In Idaho, her mental health had previously delayed her trial after she was found incompetent in 2021 and required treatment at a mental health facility. Although she was later deemed fit for trial, her competency was questioned multiple times during the Idaho proceedings.   In the recent Arizona hearing, Daybell’s new defense attorneys, Pamela Hicks and Robert Abernathy, argued to withdraw the Rule 11 evaluation motion filed by her former counsel. Hicks stated, “She has sufficient mental capacity to understand the nature of this dispute, and there has been no history of irrational behavior.”   However, Judge Beresky decided the evaluation should proceed, citing its importance in ensuring the fairness of the legal process. “We’re going down a rabbit hole,” said Abernathy, as Daybell nodded in agreement. “If she doesn’t want to talk to the doctors, she doesn’t have to talk to the doctors.”   Despite the defense’s objections, prosecutors in Maricopa County successfully requested that Daybell speak with an additional expert. Judge Beresky maintained the Rule 11 process, ordering further evaluation.   During the hearing, Daybell also expressed her interest in representing herself in the Arizona case. When asked by Beresky about her past competency determinations, Daybell responded, “Not to my understanding. My understanding was the judge did the same thing you did in an abundance of caution and I came out competent.” She detailed her experiences in Idaho, noting she underwent “competency classes, meeting with doctors, and many, many evaluators.”   Her legal defense is now preparing for the next steps as Daybell undergoes further assessments. Diddy Fights to Appear Unshackled in Court as Legal Troubles Mount

Sean "Diddy" Combs has filed a request through his attorney to appear unshackled during court proceedings. The motion, submitted late on Monday, Nov. 18, argues that shackling the music mogul creates risks of juror bias and hampers his ability to communicate with his defense team. “We write on behalf of our client, Mr. Sean Combs, to respectfully request that the Court direct the United States Marshals Service to unshackle Mr. Combs prior to bringing him into the courtroom for tomorrow's hearing and for all future court appearances,” his attorney, Marc Agnifilo, wrote in court documents obtained by PEOPLE. This request follows Combs’ Oct. 10 court appearance, during which he remained in leg shackles. Agnifilo stated there was “no justification” for such treatment and highlighted concerns that media coverage of his shackling could influence potential jurors. “Given the press attention on the pretrial proceedings in this case, there is a substantial risk that potential jurors will learn about the shackling through the media and develop such a bias,” Agnifilo argued. The motion also claims that shackling interferes with Combs’ ability to effectively communicate with his legal counsel, undermining the respectful treatment of defendants. ### Allegations of Jail Violations The motion comes amidst allegations from prosecutors that Combs violated jail rules. According to documents filed on Friday, Nov. 15, Combs used a "non-authorized third-party messaging service" to communicate with multiple people while incarcerated in Brooklyn. Prosecutors further allege that he enlisted his children to launch a social media campaign tied to his birthday, potentially influencing jurors. This follows Combs’ unsuccessful bail motion earlier this month. His attorneys proposed a $50 million bail package, arguing that newly surfaced evidence supports his release. The prosecution, however, pointed to Combs’ history of alleged “freak offs” and referenced a March 2016 video, described in the indictment as evidence of assault. Combs’ defense pushed back, claiming the video showed a consensual relationship, not coercion. “The video is not evidence of a coerced 'freak off,' but rather a minutes-long glimpse into a complex but decade-long consensual relationship between Mr. Combs and Victim 1,” his lawyers stated in the motion. ### Trial Scheduled for May 2025 Facing racketeering and sex trafficking charges, Combs has pleaded not guilty to all allegations. Susan Smith Denied Parole 30 Years After Drowning Her Two Sons

Susan Smith, the South Carolina mother convicted of murdering her two sons in 1994, was denied parole on Wednesday, Nov. 20, after appearing before the South Carolina parole board. The denial comes nearly three decades after Smith drove her car into a lake with her children, Michael (3) and Alex (14 months), strapped inside, a crime that shocked the nation.   Smith, now 53, appeared via videoconference and addressed the board with remorse. “I know that what I did was horrible,” she said, according to CNN. She added, “I am a Christian and God is a big part of my life and I know he has forgiven me and I know that is by his grace and mercy … And I just ask that you show that same kind of mercy as well.”   The board rejected her request, citing the severity of her crime.   On October 25, 1994, Susan, then 23, claimed that a Black man had carjacked her vehicle with her sons still inside, prompting a national search. For nine days, she made tearful public pleas for their safe return. However, the truth unraveled when Susan confessed to letting her car roll into John D. Long Lake, killing her children.   Prosecutors revealed that Susan’s motive stemmed from her affair with a wealthy man who had ended their relationship because she had children. In 1995, she was convicted of two counts of murder and sentenced to life in prison.   Her ex-husband, David Smith, reflected on her actions during an interview with the *Today* show, stating, “I don’t think Susan should ever be granted parole. It wasn’t an accident; she deliberately killed our boys.”   David also described the lingering anger he felt during the trial. “I used to sit there and look at the back of her head and then look at where the bailiffs were and think about killing her,” he admitted.   Smith’s time in prison at Leath Correctional Institution in Greenwood, South Carolina, has been marked by disciplinary infractions. She has been punished for self-mutilation, drug use, and unauthorized interviews, among other violations. She was also disciplined for having sexual relationships with two prison staff members, both of whom faced criminal charges.   In 2015, Smith wrote to a local newspaper in an attempt to defend her character. “I am not the monster society thinks I am. I am far from it,” she claimed.   Despite these statements, critics, including her ex-husband, believe she has not demonstrated genuine remorse. “I don’t think she’ll ever be rehabilitated,” David told the *Today* show.   Though he opposes her release, David has spoken about his journey to forgiveness. “Yes, I have forgiven her, but that doesn’t take away what she did. It doesn’t make it easier,” he told Court TV in September.   David continues to grieve the loss of his sons, holding on to memories of Michael and Alex. A photograph of him holding their picture outside the courthouse after the verdict in 1995 remains a poignant reminder of the tragedy.   The South Carolina parole board hears dozens of cases each day, but Smith’s high-profile application garnered widespread attention. To secure parole, she needed a two-thirds majority vote from the seven-member panel, which she did not achieve.   Parole for violent offenders in South Carolina is rare, with only 8% of applicants granted release. Alysia Adams Withdraws Guilty Plea in Murder of 4-Year-Old Athena Brownfield; Death Penalty Sought

Alysia Adams, a woman from Caddo County, Oklahoma, declined to plead guilty on Wednesday to the murder of 4-year-old Athena Brownfield, reversing her decision moments before a scheduled court hearing. The unexpected move has reinstated the possibility of the death penalty if she is found guilty at trial. Athena's grandparents had traveled four hours to attend the hearing, anticipating a guilty plea from Adams. "Very disappointed; we have been patiently waiting for almost 22 months for some sort of justice for our granddaughters, and it's postponed again. Justice keeps getting postponed," said Misty Faircloth, Athena's maternal grandmother. In January 2023, Alysia Adams and her estranged husband, Ivon Adams, were arrested after Athena, who was in their care, went missing. Following their questioning, agents from the Oklahoma State Bureau of Investigation (OSBI) discovered Athena's body in a shallow grave in Rush Springs. Investigators allege that Ivon Adams beat her to death on Christmas Day in 2022. A medical examiner later concluded that Athena died from pneumonia and malnutrition, weighing only 23 pounds at the time of her death. Alysia Adams' social media posts in the days following Athena's death showed her attending social events and spending time with a new boyfriend. The plea deal, set to be considered at Wednesday's hearing, was taken off the table by Adams just minutes before proceedings were scheduled to begin. District Attorney Jason Hicks announced in court that he would have withdrawn his request for the death penalty if she had pleaded guilty. With the plea deal now void, Hicks stated he plans to seek the death penalty at trial. Legal experts noted the rarity of such a last-minute decision. "This is a decision that few people really ever have to realize what they're doing and the ramifications of such," said Oklahoma City criminal defense attorney Robert Gifford. He suggested that Adams may have changed her mind due to a belief in her innocence or the gravity of the decision. Gifford explained that the plea withdrawal opens the door for a lengthy and complex trial process. "You don't go into a death penalty case like you would any other case. You have to have enough resources. You have to have investigators. You have to have a mitigation specialist," he said, emphasizing the extensive preparation required for such cases. The case has already garnered significant media attention, which could complicate the selection of an unbiased jury. Gifford highlighted the challenges ahead, stating that the defense would need to navigate the heightened scrutiny and public interest. Athena's disappearance on January 10, 2023, prompted a massive search after a postal carrier found her older sister, Adina, wandering outside their home in Cyril, Oklahoma, about 70 miles southwest of Oklahoma City. The 5-year-old told the carrier she had been alone and was tired, leading to the involvement of law enforcement. The search concluded a week later when OSBI agents recovered Athena's remains. Her body was found inside a zipped black backpack buried in a shallow grave in a field. Initially, prosecutors believed Athena had been beaten to death based on statements from Alysia Adams about her husband. However, the autopsy found no evidence of assault, leading to a revision of the charges. Ivon Adams, 38, now faces charges of second-degree murder, child neglect for leaving Athena's sister without supervision, and unlawful removal of a dead body for allegedly burying Athena. Sean “Diddy” Combs Faces New Wave of Sexual Assault Lawsuits

The legal troubles surrounding Sean "Diddy" Combs have escalated as five new lawsuits accuse the music mogul of drugging and sexually assaulting both men and women over a two-decade span. The allegations, which range from 2001 to 2022, detail disturbing incidents at parties and events in New York City, Miami, and the Hamptons.   Filing anonymously under the names "Jane Doe" and "John Doe," the plaintiffs allege patterns of misconduct involving drugs, coercion, and threats to ensure silence. Two of the female plaintiffs claim they were minors at the time of the alleged assaults, while three male accusers describe being drugged and sodomized by Combs and his associates.   One of the most notable accusations centers on Combs' 2004 White Party in the Hamptons, where a seventeen-year-old Jane Doe claims she was forced to surrender her cell phone and purse before entering the event. According to the lawsuit, after consuming a drink provided at the party, she lost consciousness and woke up to find she had been sexually assaulted. She alleges that Combs and his bodyguards warned her to stay silent, stating, "He runs New York and would ruin her."   Another lawsuit details a 2001 casting call for a music video in New York City, where John Doe claims he was offered a Diet Coke that was laced with drugs. He recounts losing consciousness and waking up disoriented, realizing he had been assaulted by both Combs and his bodyguard.   Attorney Tony Buzbee, representing the plaintiffs, has publicly committed to holding Combs accountable. “These individuals were victimized by someone who used power and privilege as a shield. We will not stop seeking justice for these survivors,” he said. Tennessee Family Devastated After Deputy Shoots and Kills Seven Dogs

A Tennessee family is reeling from a tragic incident in which seven of their beloved dogs were shot and killed by a sheriff’s deputy while the family was out for dinner. Kevin Dismuke and his wife left their McNairy County home for an evening out but returned to devastating news. "She said, ‘Poe is dead,’” Dismuke recalled his wife telling him, referring to one of their dogs. When he got back to their property he found that only one of their dogs had survived. “They were all gone except one,” he said. The horrifying incident occurred when Deputy Connor Brackin, 24, from the McNairy County Sheriff’s Department, arrived at the property in response to a welfare call concerning the dogs. According to the Tennessee Bureau of Investigation (TBI), Brackin was dispatched to check on reports that the dogs were malnourished and abandoned. However, Dismuke has disputed these claims. “They were told the property was abandoned and the dogs were malnourished,” he explained. “I got the veterinary paperwork in my truck from three weeks ago. They all had a clean bill of health on them.” A neighbor later informed Dismuke that a deputy had arrived and started shooting. Details from the affidavit of complaint revealed that some of the dogs were inside campers when Brackin began firing. The deputy “loaded his service rifle and pistol and began firing into the campers at the dogs,” the affidavit alleges. Brackin reportedly fired eight times from outside the campers and then multiple times from inside, clearing the area afterward. The TBI has confirmed that the incident was captured on Brackin’s body camera. On Nov. 12, TBI agents issued warrants for Brackin, charging him with seven counts of aggravated animal cruelty and eight counts of reckless endangerment. The deputy turned himself in and was booked into the McNairy County Jail, but he was released while awaiting further court proceedings. The sheriff’s office later confirmed that Brackin, who had been with the department for less than a month, resigned following the arrest. Dismuke and his family remain heartbroken over the loss of their pets. “I don’t care if you give me $10 if you give me $10 million," Dismuke said. Prosecutors Allege Sean 'Diddy' Combs Tried to Tamper with Witnesses, Influence Jurors from Jail

Federal prosecutors are urging a judge not to grant Sean "Diddy" Combs bail, accusing the music mogul of witness tampering and attempting to influence potential jurors from his cell in the Metropolitan Detention Center in Brooklyn. Combs, the founder of Bad Boy Records, faces serious charges, including sex trafficking, racketeering, and transportation for the purpose of engaging in prostitution. In a motion filed Friday, prosecutors emphasized that Combs has made relentless efforts to contact witnesses, including some of his alleged victims. They insist that the charges are not as strong as prosecutors claim and that certain incidents, like a 2016 video showing him allegedly assaulting a woman in a Los Angeles hotel, have been misconstrued. “The video is not evidence of a coerced 'freak off,' but rather a minutes-long glimpse into a complex but decade-long consensual relationship between Mr. Combs and Victim 1,” the defense countered in a Nov. 8 filing. The amount of commercials is ridiculous! Who cares if the information is interesting? Essentially when there are MORE commercials than content. Other podcasts are more valuable and worthy than you're drivel, prostituted over multiple streams as "true crime".

You have more commercial than local TV! 10 minute podcast 6 minutes of commercials. AND YOU REPEAT THE SAME ONE MULTIPLE TIMES IN THOSE 10 MINUTES. Unsubscribing because it's unlistenable even though you do have good content, but not enough to tolerate trashing my ears.
