A “right” is a moral principle defining and sanctioning a man’s freedom of action in a social context. There is only one fundamental right (all the others are its consequences or corollaries): a man’s right to his own life. Life is a process of self-sustaining and self-generated action; the right to life means the right to engage in self-sustaining and self-generated action—which means: the freedom to take all the actions required by the nature of a rational being for the support, the furtherance, the fulfillment and the enjoyment of his own life. (Such is the meaning of the right to life, liberty and the pursuit of happiness.)The concept of individual rights is so new in human history that most men have not grasped it fully to this day. In accordance with the two theories of ethics, the mystical or the social, some men assert that rights are a gift of God—others, that rights are a gift of society. But, in fact, the source of rights is man’s nature.Individual rights is the only proper principle of human coexistence, because it rests on man's nature, i.e., the nature and requirements of a conceptual consciousness. Man gains enormous values from dealing with other men; living in a human society is his proper way of life—but only on certain conditions. Man is not a lone wolf and he is not a social animal. He is a contractual animal. He has to plan his life long-range, make his own choices, and deal with other men by voluntary agreement (and he has to be able to rely on their observance of the agreements they entered).The Declaration of Independence stated that men “are endowed by their Creator with certain unalienable rights.” Whether one believes that man is the product of a Creator or of nature, the issue of man’s origin does not alter the fact that he is an entity of a specific kind—a rational being—that he cannot function successfully under coercion, and that rights are a necessary condition of his particular mode of survival.The Right to the Pursuit of Happiness means man's right to live for himself, to choose what constitutes his own private, personal, individual happiness and to work for its achievement, so long as he respects the same right in others. It means that Man cannot be forced to devote his life to the happiness of another man nor of any number of other men. It means that the collective cannot decide what is to be the purpose of a man's existence nor prescribe his choice of happiness.Since Man has inalienable individual rights, this means that the same rights are held, individually, by every man, by all men, at all times. Therefore, the rights of one man cannot and must not violate the rights of another.For instance: a man has the right to live, but he has no right to take the life of another. He has the right to be free, but no right to enslave another. He has the right to choose his own happiness, but no right to decide that his happiness lies in the misery (or murder or robbery or enslavement) of another. The very right upon which he acts defines the same right of another man, and serves as a guide to tell him what he may or may not do.If some men are entitled by right to the products of the work of others, it means that those others are deprived of rights and condemned to slave labor.Any alleged "right" of one man, which necessitates the violation of the rights of another, is not and cannot be a right. No man can have a right to impose an unchosen obligation, an unrewarded duty or an involuntary servitude on another man. There can be no such thing as "the right to enslave."Since only an individual man can possess rights, the expression "individual rights" is a redundancy (which one has to use for purposes of clarification in today's intellectual chaos). But the expression "collective rights" is a contradiction in terms. A group, as such, has no rights. A man can neither acquire new rights by joining a group nor lose the rights which he does possess. The principle of individual rights is the only moral base of all groups or associations.“The source of man’s rights is not divine law or congressional law, but the law of identity. If man is to live on earth, it is right for him to use his mind, it is right to act on his own free judgment, it is right to work for his values and to keep the product of his work. A right is that which can be exercised without anyone's permission.If you exist only because society permits you to exist—you have no right to your own life. A permission can be revoked at any time.If, before undertaking some action, you must obtain the permission of society—you are not free, whether such permission is granted to you or not. Only a slave acts on permission. A permission is not a right.Do not make the mistake, at this point, of thinking that a worker is a slave and that he holds his job by his employer's permission. He does not hold it by permission—but by contract, that is, by a voluntary mutual agreement. A worker can quit his job. “It took centuries of intellectual, philosophical development to achieve political freedom. It was a long struggle, stretching from Aristotle to John Locke to the Founding Fathers. The system they established was not based on unlimited majority rule, but on its opposite: on individual rights, which were not to be alienated by majority vote or minority plotting. The individual was not left at the mercy of his neighbors or his leaders: the Constitutional system of checks and balances was scientifically devised to protect him from both. This was the great American achievement—and if concern for the actual welfare of other nations were our present leaders’ motive, this is what we should have been teaching the world.The most profoundly revolutionary achievement of the United States of America was the subordination of society to moral law. The principle of man’s individual rights represented the extension of morality into the social system—as a limitation on the power of the state, as man’s protection against the brute force of the collective, as the subordination of might to right. The United States was the first moral society in history. All previous systems had regarded man as a sacrificial means to the ends of others, and society as an end in itself. The United States regarded man as an end in himself, and society as a means to the peaceful, orderly, voluntary co-existence of individuals. All previous systems had held that man’s life belongs to society, that society can dispose of him in any way it pleases, and that any freedom he enjoys is his only by favor, by the permission of society, which may be revoked at any time. The United States held that man’s life is his by right (which means: by moral principle and by his nature), that a right is the property of an individual, that society as such has no rights, and that the only moral purpose of a government is the protection of individual rights.America’s founding ideal was the principle of individual rights. Nothing more—and nothing less. The rest—everything that America achieved, everything she became, everything “noble and just,” and heroic, and great, and unprecedented in human history—was the logical consequence of fidelity to that one principle. The first consequence was the principle of political freedom, i.e., an individual’s freedom from physical compulsion, coercion or interference by the government.
