Hosts Rick Gregorek and Ted Hanson discuss the various aspects of the proposed Biden Tax Plan as compared to what is in place presently.  The critical element is what you do with respect to taxes.  Tune in for a frank discussion.  Your Partner in Law's main goal is to provide timely, accurate information to its listeners regarding Estate and Elder Planning, Real Estate, Business Law so that you can make wise informed decisions regardless of the tax code.  Taxes aren't going to go away and they will likely be a political football for the foreseeable future.  How you choose to manage your taxes will be a significant factor in your legacy.  While all of us grumble a bit when paying our taxes, I do believe that the majority understand that taxes are necessary.  But what taxes, who pays the taxes, etc. will be discussed and debated vigorously by both sides of the political aisle.   And most important of all, taxes are just a part of Estate Planning, there are far more important aspects that need to be addressed.  Privacy, control, carrying out your legacy goals...Establish your plan then maintain it to keep it current and relevant.   Our thoughts and prayers to all those impacted by COVID-19.  This pandemic will reshape our world and the economies of the world.  It will be incumbent on each of us to understand the "new" paradigm we'll be facing and how they may impact us personally.

Your Partner in Law, Rick Gregorek along with Ted Hanson discuss what you should do when a loved one passes away.  Confusion is ever present and your actions depend on the type of planning or lack of planning the decedent did during their lifetime.  There are separate rules for dying without a Will (intestacy), dying with a Will (testacy) or using a revocable living trust.  In addition to these various means to have an estate plan you must also be cognizant of how title (ownership) is held between two or more individuals or entities.  Certain titling will derail even the best prepared estate plans.  My most frequently stated law intervenes:  The Law of Unintended Consequences, a corollary to Murphy's Law - you know -what ever can go wrong does.  Don't get trapped, proper estate planning is the answer.  Gregorek and Associates, PLLC offers free estate and elder law consultations as well as our exclusive Life Plan Organizer for the asking.
Your Partner In Law host Rick Gregorek and his co-host Ted Hanson discuss what you should be doing NOW with the upcoming election.  Both presidential candidates have made their tax plan available to the public on their respective websites.  During this show Rick and Ted discuss the differences in the two tax plans and what you should do, as the old saying goes, two things are for sure - Death and Taxes.  With the avalanche of wealth transfer that is in the beginning stages will result in over $30 Trillion being transferred upon the death of these baby boomers.  Don't think for a moment that the Tax Man isn't eying this transfer of wealth as a way to fill the Treasury coffers.  Don't miss this opportunity to plan for you and your loved ones.  And business owners, you must remember that your estate plan must be properly integrated into your estate plan.
We all have lots of questions when it comes to estate or elder law planning.  The questions we have tend to result in "Planning Paralysis."  Overcoming this is the first step in your planning process.  Attorneys Rick Gregorek and Ted Hanson discuss the fundamentals to get you started on the planning process and to overcome Planning Paralysis.  Listen in to get your FREE Life Plan Organizer at www.YourPartnerInLaw.com and schedule your FREE Estate or Elder Law consultation with an attorney.
2020 has been a turbulent year beginning with COVID-19 becoming a world wide pandemic, then the ensuing financial collapse of the globe and here at home, then Geroge Floyd is killed on camera by a Minneapolis police officer, demonstrations began across the country, peaceful protest often turned to vilence, looting, burning and murder.  All this is what is likely the most contentious Presidential race in modern history.  A nation divided.  With the passing of Justice Ruth Bader Ginsberg on Friday, September 18, 2020 the election just got a lot more fuel added to it.  Our politicians need to take their lead from Justice Ginsberg - she was able to have civil discourse with her most ardent opponents, yet not only be civil, but to actually embrace as friends.  Our differences are what make us who we are as a person.  She was best friends with Anton Scalia who was on the opposite of many of Ginsberg's opinions, yet they worked together for resolution. How is this relevant for Estate and Elder Planning you may ask?  It's relevant because the ultimate person appointed to fill Justice Ginberg's seat is appointed for life and will shape the court for decades.  This means your vote for President will likely have far longer ramifications than just four years.  Impacts to taxes, income, capital gains and estate; business regulation, free speech and other foundational constitutional rights will be in play.  Civil Rights in many aspects will be on trial itself.  Please do your homework and VOTE. I urge everyone to take a look at your own situation and either establish or update your estate plan to be flexible to react to an ever changing landscape for taxes and legislation.  Don't get caught without a proper estate plan that effectively communicates your desires properly to achieve your goals and objectives.  Be aware of State Estate Taxes, you usually only hear about the Federal Estate in the news.  Many Washingtonians find themselves being subject to estate taxes and they were totally unaware, costing the beneficiaries a significant portion of their inheritance.  Don't fall prey to the "Law of Unintended Consequences"  this is the natural extension of "Murphy's Law" which we all know too well.  Tune in and get ready to Plan! Is a Will Based or a Trust Based Estate Plan for You?  Let the dedicated attorneys at Gregorek and Associates, PLLC help you decide.

Rick Gregorek and Ted Hanson have a frank and sobering discussion of the impacts of the COVID-19 and economic ramifications on seniors and what family, friends and professionals can do to assist seniors during this difficult and dangerous time.  For our firm and firms across the state and the country are experiencing increases in after death work including probate and trust administration.  Presently courts are slow as well due to COVID-19 restrictions.  We all know that the virus is far more deadly for seniors than for any other age group.  Underlying medical conditions, often referred to as co-morbidities, greatly increase the potential for serious or deadly consequences from the virus.  Rick and Ted stress the need for a proper estate plan that is tailored to the individual’s personal situation and their goals and objectives.  For some, estate planning involves estate tax planning, asset protection and more.  For others it is figuring out how their care will be aid for when they lack personal assets to provide for their medical care and housing, we refer to this as elder planning and are creating an estate (elder law) plan as a result of diminishing assets and one’s inability to provide for their own care and housing.  This second group is most at risk by not having an estate plan.  Avoid the common pitfalls and mistakes for you estate planning.  The law firm of GREGOREK AND ASSOCIATES, PLLC  is OPEN FOR BUSINESS.  We can accommodate you for in office meetings, telephone or video conferencing, in-home or in facility visits.  We will adapt to your needs to assist you in establishing your estate plan.
