This is the audio version of my reading out the legal opinion that I wrote which Parry Field Lawyers has released this week on the 20th March 2024.  It tackles the issue of large funds and trusts which have amounts they invest, often conservatively.  It asks: do those in governance of such entities actually now have a positive duty to invest funds for impact?   I argue that they do for a variety of reasons.  For example, because the new Trusts Act 2019 includes provisions which mean Trustees should consider the original purpose that the Trust was set up for when they go about investing.  As well as that, some of their duties can be modified now which would allow them to invest for impact and advancing the purpose of their Trust.  The opinion also outlines the 9 practical realities that I think need to be considered as well – check them out too.  On the same day as releasing this am in conversation with Shamubeel Eaqub about impact investing - what it is, how it is growing and the impact for both business and charities.  Watch out for that as a follow up episode.  Thanks to my wife Ellie Moe for reading the headings of the opinion in this episode. Change is a certainty in life, but how will you cope with it?  I enjoyed talking with Rob Cousins about the venture he cofounded called Open Change.  As usual we start with his childhood and then hear about his life journey and what led him to Aotearoa New Zealand what he does today. The podcast aims to get at the underlying stories of what has shaped people into who they are becoming and is a deeper glimpse into a life than we normally get.   We then talk about the complex and entangled challenges that are all around us - how do you approach them?  The website of Open Change described the issue like this: "Change used to be done to people. A few weeks ago, I sat down with Steven and had a solid, fun, recorded conversation on purpose and life. Steven recently published a legal handbook on social enterprises in New Zealand and has been doing interviews with entrepreneurs and social enterprises about their journeys on this podcast. Through mutual friends and overlapping circles we got connected quite quickly. I feel honored to have been invited to be on the podcast. The growing list of humans and their truly impressive set of accomplishments and contributions to earth and society are humbling. Steven masterfully guided the conversation from my childhood to teenager years as an immigrant, as he waives into it his own story and aspirations, and we move into my university days and during that the exposure to the greater world, its beauty, its problems, my craft, and my finding of sometimes-often bumpy pathways that have taken me where I am currently. I told him it has been years since anyone has dug that deep to my past-histor
