We begin by looking at the three elements of consent - it must be informed, voluntary and the patient must have capacity to make the decision. Following this, we consider each in more detail looking at Montgomery v Lanarkshire (material risks) and look at the Mental Capacity Act 2005 in some detail in regards to each of the 5 principles, the two stage mental capacity test and best interests decisions.
