Yes, the 14th Amendment to the U.S. Constitution does apply to children born in the United States, regardless of their parents' immigration status. The Citizenship Clause of the 14th Amendment states: > "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." This means that any child born on U.S. soil is automatically a U.S. citizen, even if their parents are in the country illegally
