The United States Supreme Court ruled Friday that states involved in two lawsuits could not enforce the Biden administration’s updated Title IX rule in states continuing the multi legal battle over sex discrimination and gender identity. The high court ruled 5-4 to deny requests from the Department of Justice to stay injunctions issued by appellate courts which blocked the Department of Education’s new rule from going into effect on the Aug. 1 deadline as litigation continues around the expanded definition of sex discrimination. The arguments between the opinion and the dissent centered on whether the unchallenged aspects of the rule should be able to stand while the courts decide whether the challenged portions are legal. The majority opinion found that the challenged portions were “intertwined” with the rest of the rule.
