The Leadville man who the Summit County Sheriff’s Office arrested in March for charges including first-degree assault with extreme indifference and driving under the influence received his sentence Aug. 25.





Deputies arrested Jovany Enriquez, 21, in March after responding to a crash on Interstate 70 between exits 201 and 203 and a report of a man fighting a woman in a nearby backyard. Law enforcement later determined the incidents were related.





Law enforcement found Enriquez near the residence where the fight was reported. The residence’s owner told deputies they heard a commotion in their backyard, saw Enriquez slamming a woman’s head into the ground, retrieved a handgun from inside the home and ordered Enriquez to stop, causing him to flee, according to a Sheriff’s Office news release from March.





Deputies found probable cause to arrest Enriquez on charges including first-degree assault with extreme indifference, a felony; reckless endangerment, a misdemeanor; reckless driving, a misdemeanor; and driving under the influence, a misdemeanor.





On Aug. 25, the court accepted a plea deal that had Enriquez plead guilty to a misdemeanor for driving under the influence and a misdemeanor traffic offense for failing to report an accident he was involved in to the police. The deal dismissed a Class 3 felony for first-degree assault with extreme indifference, a Class 4 felony for leaving the scene of an accident and five other lesser charges, including being a minor in possession of alcohol, reckless driving and reckless endangerment.





Judge Robert Gregory sentenced Enriquez to 27 days in jail with 22 days of credit for time served. Enriquez also has a 365-day jail sentence with suspended imposition, meaning that part of his sentence will not be imposed unless he violates his 12-month probation. 





During his probation, Enriquez must complete 30 days of community service; commit no crimes besides minor traffic infractions; not drive without a valid license; complete an alcohol evaluation and comply with the probation department’s recommendations; and not consume alcohol or drugs not prescribed to him, including marijuana. 





The sentence also requires him to pay fines and costs totaling almost $2,000.
