This Privacy Policy (the "Policy") describes the types of Personal Information that Guru Network Limited (referred to in this Privacy Policy as "Company," "we," "us," or "our"), as the operator of the website https://castbox.fm (the "Site") and the developer of the associated Castbox mobile application, auto application, and smart home application (the "App"), collects from and about you when you visit the Site or use the App, or any other website, pages, features, or content owned or operated by Company (separately and collectively, the "Services"). Guru Network Limited is the data controller responsible for your Personal Information. This Policy also explains how we may use and disclose your Personal Information and your rights with respect to such Personal Information. Terms not defined in this Policy shall have the meaning given to them in our Terms of Service. This Policy is part of, and is governed by, the terms and conditions set forth in our Terms of Service located at castbox.fm/termsofservice.html.

For purposes of this Policy, "Personal Information" refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you, and includes "personal data" or similar terms as defined in applicable law.

Please read this Policy carefully before you use or access our Services. By using the Services, you agree to our collection, storage, use and disclosure of your Personal Information as described in this Policy. If you disagree with this Policy, please do not use the Services.

1. Notice at Collection of Personal Information

We collect the categories of Personal Information identified below. As indicated in the chart, we engage in "sales," "sharing," and "targeted advertising" (as such terms are defined in U.S. law) through our disclosure of certain categories of Personal Information for marketing, advertising, and analytics purposes to business partners and third parties, such as data analytics providers, advertising technology vendors, third-party advertising networks, and social media platforms.

Please send an email to contact@castbox.fm to opt out of "sales," "sharing," or "targeted advertising" involving your Personal Information. You may also choose to enable online, where available, a universal tool that automatically communicates your opt-out preferences, such as the Global Privacy Control ("GPC"). We will process the GPC signal as a request to opt out.

B. The Business and Commercial Purposes for Which We Collect and Use Your Personal Information

  • To Provide Our Services. In order to provide you with our Services, we need to process your Personal Information.
  • To Send You Service-Related Communications. We want to make sure you stay informed about service- or account-related news, updates, or changes by sending you communications via email, in-app notifications and any other methods as permitted by law. For example, we may send you communications about changes to our security policies, your transaction information, or other important transaction information.
  • To Respond to You. When you contact us with questions, feedback, or any other concerns, we use any Personal Information that you provide to us to respond to you.
  • To Enforce Compliance with Our Terms, Agreements or Policies. We monitor and enforce your compliance with our Terms of Service, and may use your Personal Information for monitoring, investigating, preventing and mitigating any alleged or actual prohibited, illicit or illegal activities on our Services or violations of our Terms of Service; enforcing our Terms of Service with third parties and/or partners; and, as applicable, collecting fees based on your use of our Services.
  • To Ensure Security on Our Service. Keeping your information secure requires us to process your Personal Information to improve and enforce our security measures. For example, we may process your Personal Information to combat spam, malware, security risks or malicious activities, or to monitor and verify your identity to prevent unauthorized access to your information.
  • To Comply with Legal and Regulatory Obligations. Our business is subject to certain laws and regulations which may require us to process your Personal Information, including to respond to lawful requests and communications from law enforcement and other government officials. For example, we may process your Personal Information to pay our taxes, fulfill our business obligations, or as necessary for us to manage our risks as required under applicable law.
  • To Personalize and Enhance Your Experience on Our Service. We want you to have the best possible experience on our Services, which is why we personalize our Services to your preferences (e.g., language selection, time zone), allow you to connect to your favorite third-party applications, and more.
  • To Conduct Research and Development. We want to continue to provide you with new or expanded services and products that you enjoy. To do so, we analyze how you interact and use our Services and other Personal Information about you for research and development purposes. We apply technical, administrative, and physical security measures to your Personal Information when we use it for research and development purposes, such as pseudonymizing or de-identifying your information where possible.
  • To Engage in Marketing Activities. We may engage in marketing activities to keep you updated about new products and services you may be interested in. We process your Personal Information, such as your contact information, to send you marketing communications, provide you with information about upcoming events, webinars or other relevant materials, and to deliver targeted marketing to you.
  • Other uses. We may also use your Personal Information to fulfill any other purpose for which you provide your Personal Information or as explained to you at the point of information collection.

C. Retention

We will retain your Personal Information for as long as reasonably necessary to provide you with our Services that you request, for marketing purposes unless you opt out as described in our Privacy Policy, or otherwise where permitted or required in accordance with applicable law. We will retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. What this means in practice will vary between different types of information, and when we consider our approach we take into account ongoing business or legal needs for the information, for example in relation to tax, health and safety, and potential or actual disputes or investigations.

2. Our Collection of Personal Information

There are several ways we may obtain the categories of Personal Information listed above in the Notice at Collection, including through (A) information you provide to us; (B) information we automatically collect; (C) information we receive from third parties; and (D) combining information from different sources.

A. Information you provide

We collect Personal Information directly from you as follows:

  • When You Use our Services. We collect Personal Information from you when inquire about or create an account to use the Services. You may use our Services as a guest or you can create an account. When you create an account with us, we will request that you provide certain Personal Information, which may include your name, e-mail address, and password. We may request additional information necessary to establish and maintain your account.
  • When You Make a Purchase. When you register an account with us, you may connect your iTunes or Android payment account with our Services or provide us with your digital currency information (i.e., cryptocurrency address).
  • Information You Directly and Voluntarily Provide to Us. If you visit or access our Services, we may collect information that you provide to us when you communicate with any of our departments, such as customer service or technical services. You can also choose to provide us with additional information about yourself in your profile, leave comments on other user's content, and take other actions by visiting or accessing our Services.

B. Information we automatically collect

When you visit and interact with our Services, we or our third-party advertising and analytics partners and service providers may use a variety of technologies, such as cookies, tags, SDKs or scripts, to collect certain information regarding your activity. To learn more about your choices regarding the automatic collection and use of your information as you browse our Services, please see the Your Privacy Choices and Rights section below.

The specific types of information that we and our partners and service providers may automatically collect when you visit and interact with our Services include:

  • Device and Browser Information. We collect information about the device you use to access or use our Services. For example, we may collect the following information from your device: the type of device you use (e.g., mobile, auto, a smart home device, etc.); your advertising Identifier ("IDFA" or "AdID"); network connection type (e.g., Bluetooth, WiFi, 3G, 4G, LTE, etc.); operating system and version (e.g., iOS, Android or Windows); language settings in your mobile device; and your mobile service carrier.
  • Usage Information. When you interact with our Services, certain information may be collected by us or our third party vendors, including information about your listening preferences, the date and time of your visit, your activity using the Services, the amount of time you spend viewing or using our Services, podcast subscriptions, keystrokes, mouse movements, form field entries, and other use and overall engagement with our Services.
  • Marketing Information. If you receive an email from us, information may be collected about your interactions with the message (e.g., whether you opened, forwarded, or clicked through to our Site).
  • Third-party analytics technologies. We may use third-party analytics tools to better understand who is using our Services, how people are using them, and how to improve their effectiveness as well as the effectiveness of any related content. For example, we use Google Analytics to collect Personal Information about you when you visit our website for purposes of remarketing, impression reporting, and demographic and interest reporting. You can opt-out of the use of this technology through the Google Analytics opt-out browser add on, Google Ad Settings, and Ad Settings for mobile apps.
  • Location Information. We collect your location when you enable location services or that we derive about your user session (e.g., via your IP address). We use location data to provide our Services, identify and correct system errors that you report, and to verify, maintain the quality of, and improve our Services.
  • Cookies & Similar Tracking Technologies. We use "cookies" and similar tracking technologies to collect information about your use of the Services, provide you with interest-based advertising, and enhance your browsing experience. For example, we collect information about the way you interact with features on our Site, how long you spend on certain pages, and whether you received an error message on our Services. Please read our Cookie Policy for more information about the cookie data we collect and how you can manage it.

C. Third-party sources of personal information

In some cases, the Personal Information we collect about you comes from third party sources, as described below.

  • Third Party Applications or Services. We may collect Personal Information about you or others from third party applications or services available on our Services. For example, when you register for an account with us, you may do so by choosing to connect your already existing social media account with our Services (e.g., Facebook, Google, etc.). We receive certain information from your social media account depending on their policies and your settings on the platforms. We use this information to make an account for you on our Services.
  • Public Databases and Social Media Platforms. For users that upload content to our Services, we may populate your content submissions with publicly available information from other platforms, which may include Personal Information about you. The purpose of the information collection is to streamline your upload process and make it easier for you to upload content on our platform. For example, we may collect descriptions, social media accounts, or tags you have used for your podcast channel on other platforms so that you can use the same information on our Services.
  • Your Friends and Family. We may receive your Personal Information from other users, such as your friends and family, when they want to share something with you through or about our Services. When you invite others to join our Services, we will contact them on your behalf.

D. Combination of personal Information

We may combine Personal Information that we receive from various sources. For example, we may combine Personal Information that we collect from you offline with Personal Information we collect from you through our Services. Similarly, we may combine Personal Information that we receive from third parties with Personal Information we already have about you. We use, disclose, and protect combined Personal Information as described in this Policy.

3. Our Disclosure of Personal Information

We may disclose each category of your Personal Information that we collect to the following categories of recipients:

  • Our Service Providers. We disclose your Personal Information to our service providers who provide certain services to us or on our behalf, such as operating and supporting the Services, analyzing data, or performing marketing or consulting services. These Service Providers will only have access to the information needed to perform these limited functions on our behalf.
  • Affiliates. As a global company we may disclose your Personal Information within the Company's corporate organization to our affiliates to provide you with the Services or to respond to your requests.
  • Mergers and Acquisitions; Bankruptcy. In the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with a bankruptcy or similar proceeding), we may disclose or transfer your Personal Information to certain third parties, such as the acquiring entity and its advisers.
  • Business Partners. As permitted by law or your consent, we may share your Personal Information with our business partners. We will identify the business partners to you at the time of data collection.
  • Marketing by Third Parties. Our Services allows you to connect with others, including third parties that may want to market to you. For example, you can leave comments on other users' content or send messages. When you use our Services and share your information with other users, such users may reach out to you for marketing purposes. We cannot control such communications nor the processing of your Personal Information that you choose to make available to others.
  • Third Parties. As disclosed in our Notice at Collection (above), we make available certain categories of Personal Information for marketing and analytics purposes to business partners and third parties, such as data analytics providers, advertising technology vendors, third-party advertising networks, and social media platforms. These disclosures may constitute a "sale," "sharing," or "targeted advertising." Please see the Your Privacy Choices and Rights section, below, to learn about how to opt out.
  • Upon Your Request. Our Services allows you to interact with third-party apps and websites, friends and family, other users, and more. For example, you can connect your Facebook account with our Services or share any content you upload on our Services with users on other platforms. We will share your Personal Information upon your request. Please note, once you decide to share information with others, we no longer control how such information may be used by the third parties in receipt of your Personal Information. Furthermore, some parts of our Services are publicly available, which means that any information you provide in these parts of our Services may be analyzed, collected, and used by others with access.
  • To Protect You, Us, or Others. We will share your Personal Information in the event we believe, in good faith, that such a disclosure would protect your interests or rights, or the interests or rights of others, including the Company and its personnel.
  • Compliance with Legal Obligations and Disclosure to Public Authorities. To the extent permitted by law, we will disclose your Personal Information to government authorities or third parties if required to do so by law, or in response to a subpoena or court order or similar request from judicial or public authority; or, we believe that you have abused the Site or Services by using it to attack other systems or to gain unauthorized access to any other system, to engage in spamming or otherwise to violate applicable laws. As permitted by law, we will try to inform you of a law enforcement request, subpoena, or similar request from judicial or public authority disclosure prior to providing our response.

We may disclose your Personal Information for other reasons that we will describe at the time of information collection or prior to disclosing your information.

Please note that we may de-identify or aggregate Personal Information so that it will no longer be considered Personal Information and disclose such information to other parties for purposes consistent with those described in this Privacy Policy.

4. Your Privacy Choices and Rights

You have the ability to make certain choices about how we use your Personal Information, as follows:

A. US residents

As a U.S. resident, you have the following rights in relation to your Personal Information:

  • Right to Know: You have the right to know what Personal Information we have collected about you, including the categories of sources from which the Personal Information is collected, the business or commercial purpose for collecting, selling, or sharing Personal Information, the categories of third parties to whom we disclose Personal Information, the categories of Personal Information disclosed to third parties, and the specific pieces of Personal Information we have collected about you. You have the right to access your information in a portable format.
  • Right to Request List of Categories of Third Parties. As a Delaware resident, you have the right to request a list of the categories of third parties to which we have disclosed your Personal Information.
  • Right to Request Specific List of Third Parties. As a resident of Oregon, Minnesota, or Connecticut, you have the right to request a list of the specific third parties with whom we have disclosed your Personal Information.
  • Right to Delete: You may have the right to request that we delete Personal Information that we have collected from or about you, subject to certain exceptions.
  • Right to Correct: You may have the right to correct inaccurate Personal Information that we may maintain about you, subject to appropriate verification.
  • Right to Opt Out of Certain Types of Personal Information Uses and Disclosures: We use and disclose to third parties Personal Information for analytics and advertising purposes. Accordingly, you may have the right to opt out of "sales," "sharing," and "targeted advertising" involving your Personal Information (as these terms are defined in applicable law).

We will not discriminate against you if you decide to exercise your privacy rights.

How to exercise your privacy rights. If you are interested in exercising your right to know, delete, or correct your Personal Information, or to request a list of categories of third parties or a specific list of third parties, please contact us at contact@castbox.fm. Please put the statement "Your Privacy Rights" in the subject field of your email. We may take steps to verify your identity before responding to your request by asking you a series of questions about your previous interactions with us. Submitting a privacy rights request does not require you to create an account with us.

If you are interested in opting out of sales, sharing, or targeted advertising, please use the Do Not Sell or Share My Personal Information link in the footer of our website or in the app settings menu. Submitting an opt-out request does not require you to create an account with us.

You can use an opt out preference signal to exercise your right to opt out of sales, sharing, or targeted advertising automatically with all businesses that you interact with online, including the Company. If you enable a browser-based opt-out preference signal, such as Global Privacy Control (GPC), upon receipt or detection, we will treat the signal as a valid request to opt out of the sales, sharing, or targeted advertising linked to that browser and any consumer profile we have associated with that browser. Please note that if you use different browsers or browser profiles, you may need to enable the signal on each browser or profile.

Appeals. If we deny your privacy request, you have the right to appeal a decision we have made in connection with your privacy rights request. To appeal a decision, please contact us at contact@castbox.fm.

Agent requests. Only you, or someone legally authorized to act on your behalf, may submit a request related to your Personal Information. Depending on your U.S. state of residence, you may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you've authorized them to act on your behalf. We retain the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent's identity.

Our role as a data processor. In many cases, we act as a service provider or processor to collect Personal Information from, or on behalf of, customers who use our services. These customers have their own privacy policies that describe how they use information. To the extent that we are processing Personal Information subject to state privacy laws on behalf of a customer in our role as a service provider or processor, you should reach out to that customer directly to exercise your rights under state privacy laws.

Our processing of sensitive personal information. Precise geolocation information that we collect is not used to infer characteristics about you or for any purpose other than the limited permissible purposes set forth in the regulations implementing California law. Such purposes include providing our Services, identifying and correcting system errors that you report, and verifying, maintaining the quality of, and improving our Services.

B. Residents of the European Economic Area, Switzerland, and the United Kingdom

We provide you with the rights described below when you use our Services. If you would like to exercise your rights under applicable law, please contact us at contact@castbox.fm. Please note, we may seek to verify your identity when we receive an individual rights request from you in order to ensure the security of your personal information.

  • Right to Withdraw Your Consent. If we ever asked for your consent to process your Personal Information, you have the right to withdraw your consent at any time. A withdrawal of consent will not affect the lawfulness of our processing or the processing of any third parties based on consent before your withdrawal.
  • Right of Access. Upon your request, we will provide you with a copy of your Personal Information in our files without undue delay and free of charge, unless we permitted by law to charge a fee. Your access may limited to the extent it would adversely affect the rights and freedoms of other individuals.
  • Right to Rectification (or "Correction"). You may request to correct or update any of your Personal Information in our files. We may provide you with the ability to update some or all of your Personal Information directly via the Services.
  • Right to Erasure (or the "Right to be Forgotten"). Upon your request, we will erase any of your Personal Information in our files that: is no longer necessary in relation to the purposes for which it was collected or otherwise processed; was collected in relation to processing that you previously consented to, but later withdrew such consent; or was collected in relation to processing activities to which you object, and there are no overriding legitimate grounds for our processing.
  • Right to Restriction. You have the right to restrict our processing of your Personal Information under certain conditions. During the time which restriction of processing applies, we will only process your restricted Personal Information with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest. We will inform you if or when the restriction is lifted.
  • Right to Object. You may object to our processing at any time and as permitted by applicable law if we process your Personal Information on the legal bases of: consent; contract; or legitimate interests. We may continue to process your Personal Information if it is necessary for the defense of legal claims, or for any other exceptions permitted by applicable law.
  • Right to Data Portability. If we process your Personal Information based on a contract with you or based on your consent, or the processing is carried out by automated means, you may request to receive your Personal Information in a structured, commonly used and machine-readable format, and to have us transfer your personal information directly to another "controller," where technically feasible, unless exercise of this right adversely affects the rights and freedoms of others. You right to data portability only applies to Personal Information provided by you to us.
  • Automated Individual Decision-Making, Including Profiling. You have the right not to be subject to a decision based solely on automated processing of your Personal Information, including profiling, which produces legal or similarly significant effects on you, unless an exception applies under applicable law.
  • Limitations to Individual Rights Requests. We may limit your individual rights requests in the following ways:
  • Where denial of access is required or authorized by law;
  • When granting access would have a negative impact on other's privacy;
  • To protect our rights and properties; and
  • Where the request is frivolous or burdensome.
  • Right to Lodge Complaints. If you believe that we have infringed or violated your privacy rights under applicable law or this Policy, please contact us at contact@castbox.fm so that we can work with you to resolve your concerns. You also have a right to lodge a complaint with a competent supervisory authority situated in a Member State of your habitual residence, place of work, or place of alleged infringement.

C. Opt out of interest-based advertising

You may be able to opt out of receiving certain targeted or interest-based advertisements using the browser opt-out tools and consumer choice mechanisms provided by advertising industry self-regulatory groups by following the links below:

You also can control whether you see interest-based advertisements on your mobile device(s) in the following ways:

  • Your device operating system may provide mechanisms that allow you to opt in or opt out of the use of information about your use of mobile apps to deliver interest-based advertising to your mobile device. For more information, consult your device settings.
  • The DAA offers a tool for opting out of the collection of cross-app data on mobile devices for interest-based advertising. To exercise your choices with respect to participating companies, please download the AppChoices tool at www.aboutads.info/appchoices.

You will need to opt out separately on all of your browsers and devices, as each opt out will apply only to the specific browser or device from which you opt out. If you delete or reset your cookies or mobile identifiers, change browsers, or use a different device, any opt-out cookie or tool may no longer work and you will have to opt out again.

Even if you choose to opt out of receiving interest-based advertising, you may still receive advertising, but the advertisements may be less relevant.

Some of our partners may provide you with additional choices with respect to interest-based advertising. For example, certain social media platforms allow you to control your advertising preferences directly through their services. Please review the privacy policies of the third-party services you use for more information.

D. Unsubscribing from our marketing communications

If you sign up to receive marketing communications from us, we will always allow you to opt-out of such emails by emailing us at contact@castbox.fm. Marketing communications include any communications to you that are only based on advertising or promoting products and services. Transactional communications about your account or our Services are not considered "marketing" communications.

5. Security

We implement industry standard security measures intended to protect against the loss, misuse and alteration of the information under our control. Please be aware that no data transmission over the Internet can be guaranteed to be 100% secure. As a result, the Company cannot guarantee or warrant the security of any information you transmit on or through the Service and you do so at your own risk.

We have put various safeguards in place to guard against unauthorised access and unnecessary retention of personal data in our systems.

You should keep your account login information confidential, and make sure any wireless connections to our Service is secure. To protect your user account, we encourage you to:

  • use a strong password which you only use for your Castbox account
  • never share your password with anyone
  • limit access to your computer and browser
  • log out once you have finished using the Castbox Service on a shared device
  • read more detail on protecting your account

If other individuals have access to your Castbox account, then they can access personal data, controls and the Castbox Service available in your account. For example, you might have allowed someone to use your account on a shared device.

It's your responsibility to only allow individuals to use your account where you're comfortable sharing this personal data with them. Anyone else's use of your Castbox account may impact your personalised recommendations and be included in your data download.

If you believe your account information has been compromised or that you have experienced unauthorized access to your account information, please contact us immediately at contact@castbox.fm.

6. Transfers of Your Information

If you choose to use the Service or provide your information to us, your Personal Information may be transferred to, processed and maintained on servers or databases located outside of the country or jurisdiction where you are located, including the United States. Such countries may have laws that are less protective than the country in which you reside. If you do not want your Personal Information transferred to or processed or maintained outside of the country or jurisdiction where you are located, you should not use the Site or Service.

Whenever we transfer Personal Information internationally, we use tools to:

  • make sure the data transfer complies with applicable law;
  • help to give your data the same level of protection as it has in the EEA.

7. Children

The Services are not intended for children or minors under the age of 18 or the applicable age of majority without consent from a parent or guardian. We do not knowingly collect or distribute Personal Information from or about children or minors under the age of 18, unless permitted to do so by local law as based on the jurisdiction in which the child resides.

If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at contact@castbox.fm. If we become aware that a child or minor under 18 or the applicable age of majority has provided us with Personal Information, we will take steps to delete such information from our files.

8. Third Party Links

Our Services may include links to third party websites or social media services. We do not control how such third parties collect, use, share or secure your Personal Information. Please read the privacy policies and settings on the third-party websites and social media services to ensure you are adequately informed how your personal information is handled.

9. Special Notice to Individuals in the European Economic Area, Switzerland and/or the United Kingdom

This section only applies to individuals that access or use our Services while located in the European Economic Area, Switzerland and/or United Kingdom (collectively, the "Designated Countries") at the time of data collection. We may ask you to identify which country you are located in when you use some of the Services, or we may rely on your IP address to identify which country you are located in.

When we rely on your IP address, we cannot apply the terms of this section to any individual that masks or otherwise hides their location information from us so as not to appear located in the Designated Countries. If any terms in this section conflict with other terms contained in this Policy, the terms in this section shall apply to users in the Designated Countries.

  • Marketing. We will only contact individuals located in the Designated Countries by electronic means (including email or SMS) based on our legitimate interests, as permitted by applicable law, or the individual's consent. When we rely on legitimate interest, we will only send you information about our Services that are similar to those which were the subject of a previous sale or negotiations of a sale to you. If you do not want us to use your Personal Information in this way, or to disclose your Personal Information to third parties for marketing purposes, please go to your account settings in the App, click an unsubscribe link in your emails, or contact us at contact@castbox.fm. You can object to direct marketing at any time and free of charge.
