The criminal defense attorneys representing Kilmar Abrego Garcia on Monday asked U.S. District Court Judge Waverly Crenshaw, the appointee of former President Barack Obama overseeing his human smuggling case, to require prosecutors to mute the audio from the body-worn camera video recorded by Tennessee Highway Patrol (THP) during his November 30, 2022 traffic stop. 

Abrego Garica's attorneys claimed in their filing that the audio attached to the THP video footage from the stop contains inadmissible hearsay, as well as "testimonial" statements from troopers, which they argue will violate the Abrego Garcia's rights under the Sixth Amendment's Confrontation Clause unless the troopers are called to testify in court.
