United States Decision of 1878. That "Question 1" to be determined by the Supreme Court in the case, asked, "1. Was the indictment bad because found by a grand jury of less than sixteen persons?" Chief Justice Waite's response opened the overall decision with a clever nuanced game that he would take further as he later addressed the remaining questions.
