Heilig geloof in wetgeving. Over geloven en wet(t)en in een democratische rechtsstaat

De vrijheid van godsdienst en levensovertuiging is sterk verankerd in de Nederlandse (Grond)wetgeving. Deze vrijheid wordt regelmatig kritisch bevraagd in de Nederlandse pluriforme samenleving, als gevolg van secularisering, ontzuiling en maatschappelijke gebeurtenissen rond veiligheid, integratie, islam en weerbare democratie.

Paul van Sasse van IJsselt toont in zijn oratie aan dat concrete veranderingen in waarborgende wetgeving vooralsnog grotendeels uitblijven, maar er wel een aanhoudende druk bestaat op de individuele en collectieve vrijheid van godsdienst en levensovertuiging en daarmee op religieuze tolerantie. Die druk is met name het gevolg van wetgeving die de omgang met orthodoxie betreft en beoogt de democratische rechtsstaat te versterken en beschermen.

Het begrip democratische rechtsstaat ondergaat daarbij een opmerkelijke betekenisverschuiving, die tevens leidt tot een kwetsbare veranderende relatie tussen overheid en religieuze organisaties. Dit roept indringende vragen op vanuit het perspectief van de consitutionele kwaliteit van wetgeving, de realisering van grondrechten als kernelement van de democratische rechtstaat en over onderscheiden verantwoordelijkheden. Van Sasse doet een aanzet voor enkele antwoordrichtingen, zoals desacralisering van de democratische rechtsstaat, verdere versterking van de constitutionele toets in het wetgevingsproces, invoering van een Wet overheid en religieuze organisaties en de instelling van een Raad voor godsdienst en levensbeschouwing.

Freedom of religion and belief is strongly anchored in Dutch (constitutional) law. This freedom is regularly questioned critically in Dutch pluralistic society, as a result of secularization, de-pillarization and social events surrounding security, integration, Islam and resilient democracy.

In his inaugural lecture, Paul van Sasse van IJsselt demonstrates that while concrete changes in safeguarding legislation are largely absent for the time being, there is persistent pressure on individual and collective freedom of religion and belief, and thus on religious tolerance. This pressure is particularly the result of legislation dealing with orthodoxy and aiming to strengthen and protect the democratic constitutional state.

The concept of democratic constitutional state undergoes a remarkable shift in meaning in the process, which also leads to a fragile changing relationship between government and religious organizations. This raises penetrating questions from the perspective of the consitutional quality of legislation, the realization of fundamental rights as a core element of the democratic constitutional state and about distinguished responsibilities. Van Sasse Van IJsselt provides an impetus for some directions of response, such as desacralization of the democratic constitutional state, further strengthening of the constitutional test in the legislative process, introduction of a Government and Religious Organizations Act and the establishment of a Council for Religion and Philosophy.
