Extern toezicht op het openbaar ministerie

Binnen de leerstoel ‘Toezicht op strafvorderlijk overheidsoptreden’ doet Hoving onderzoek naar hoe toezicht er aan kan bijdragen dat de organisaties die zich bezig houden met de opsporing en vervolging van strafbare feiten, zoals de politie en het OM, zo goed mogelijk hun werk doen. Daarbij is het interessant dat het OM een magistratelijke organisatie is die ook zelf een taak heeft bij de handhaving van de (straf)wet. Mede hierdoor heeft het toezicht op het OM een ander karakter dan het toezicht op bijvoorbeeld banken, ziekenhuizen of scholen.

Uit onderzoeken van externe toezichthouders blijkt het OM soms fouten maakt bij de uitvoering van zijn taken. De toezichthouders doen aanbevelingen om die fouten te voorkomen. Vaak worden deze aanbevelingen door het OM opgevolgd. Maar niet altijd leidt het toezicht tot gedragsverandering. In de oratie gaat Hoving in op enkele verklaringen daarvoor.

Within the chair of 'Supervision of Government Criminal Proceedings', Hoving conducts research into how supervision can contribute to the organizations involved in the investigation and prosecution of criminal offenses, such as the police and the Public Prosecution Service (OM), doing their work as well as possible. Here it is interesting that the OM is a magisterial organization that itself also has a task in enforcing the (criminal) law. Partly because of this, supervision of the OM has a different character than supervision of banks, hospitals or schools, for example.

Investigations by external supervisors show the OM sometimes makes mistakes in carrying out its duties. The supervisors make recommendations to prevent those mistakes. Often these recommendations are followed by the OM. But supervision does not always lead to behavioral change. In the oration, Hoving discusses some explanations for this.
