Duurzaam aanbestedingsrecht. Herijking van de interne markt voor overheidsopdrachten

Door duurzaam aan te besteden kunnen overheden twee vliegen in één klap slaan: ze voorzien in hun eigen behoeften én dragen bij aan maatschappelijke uitdagingen als klimaatverandering en sociale ongelijkheid. Overheden kunnen via het uitgeven van ons belastinggeld markten veranderen door alleen te contracteren met groene en sociale marktpartijen. Duurzaam aanbesteden is een no-brainer en krijgt steeds meer aandacht, maar gebeurt veelal toch mondjesmaat of is niet effectief.

In zijn oratie stelt Janssen zich de vraag hoe de Europese aanbestedingsregels zich verhouden tot het streven naar een duurzame maatschappij. Sinds de jaren 70 probeert dit rechtsgebied, gestoeld op beginselen van non-discriminatie, gelijkheid, transparantie en proportionaliteit, een interne markt voor overheidsopdrachten te creëren. Vormen deze regels een obstakel in de noodzakelijke duurzaamheidstransitie?

Through sustainable procurement, governments can kill two birds with one stone: they meet their own needs and contribute to societal challenges such as climate change and social inequality. By spending our tax money, governments can change markets by only contracting with green and social market players. Sustainable procurement is a no-brainer and is receiving more and more attention, but it is often done piecemeal or ineffective.

In his inaugural lecture, Janssen asks how European procurement rules relate to the pursuit of a sustainable society. Since the 1970s, this area of law, founded on principles of non-discrimination, equality, transparency and proportionality, has been trying to create an internal market for public procurement. Are these rules an obstacle in the necessary sustainability transition?
